2 8th Amendment The 8th Amendment states that excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

3 Roper vs Simmons In this case Christopher Simmons a 17 year old junior from Missouri was convicted for the first degree murder of Shirley Crook. Chris broke and entered Shirley’s home on September 9th, 1993 at 3am He tied up and duct taped all of Shirley’s body and drove her to a National Park where he threw her off a bridge on the Meramec River

4 After the murder On September 10th local fishermen find her lifeless body in the river after wondering “what was under all that duct tape”. Mr. Crook returned from an overnight trip and reported his wife missing after trying to find her and seeing that there was a mess in his house. Chris’s friends reported that Chris was bragging about how he killed a women and that he did it “because the bitch seen my face”.

5 How The Amendment Came To Effect!!!
He committed the crime when he was 17 His judge pointed out during the defence about his age They used the court case Atkins v. Virginia so they could repel the death penalty that was put on Chris They sentenced Simmons to “life imprisonment without eligibility for probation, parole, or release except by act of the Governor
