Dispute Resolution Policy
Should the Board Adopt a Policy? Challenges that cause us to question the need for, and benefits of, a policy: It is extremely difficult to find a mediator with the technical expertise to make reasoned, independent judgments on key questions. Defining the types of disputes that are subject to the policy is likely to lead to controversy and poor outcomes, and to place WECC in untenable positions. The prior policy subjected several types of disputes to the policy's binding arbitration rules. Only disputes related to path ratings remain applicable to a policy. Fundamental disagreements exist among the Classes regarding the transparency that should accompany a dispute resolution process.
