2 Changes to MSHA’s Workplace Exam Rule
Went into effect June 2nd, 2018 MSHA will start enforcement of new rule changes October 1st, 2018

3 1. Designate a Competent Person
Designate a competent person to examine each workplace at least once per shift, before work begins, or as miners enter the work area, for conditions that may adversely affect safety or health. Competent person definition has not changed. It can be a Manager, Supervisor or Competent Person(s) Train the person(s) you designate as competent person and DOCUMENT this task Training.

4 Competent person Workplace Examinations
Must Examine the entire work area (any place work will be performed). You DO NOT have to inspect areas where no mining processes are being performed that day. If you have a 2nd shift that day, the 1st shift competent person(s) can do the workplace exam at the end of their shift for the following shift coming on to the site.

5 Competent Person items to look for…
Examples – You should be able to identify ALL potential safety hazards/adverse conditions such as: Grounds/Housekeeping – - Weather condition issues/ice, snow, rain Berms in place, roads clear of hazards No loose rock fall hazards along highwalls Catwalks and walking areas around all plant equipment free of rocks and material build-up Slip, Trip, Fall Hazards – Things lying around or in walking areas

6 Competent Person items to look for…
Plant Equipment – - All Guards in place / Secure - Electrical – No cuts in cords or wiring Buildings.shops/warehouses – - Good Housekeeping – tools in place, floors clean of slippery fluids or materials Tools in good condition – electrical, no chipped edges, guards in place Rolling Stock - - Pre-shifts completed before put into service

7 2. Promptly initiate corrective action when hazardous conditions are found.
If it is something you can fix right away, fix it. You do not have to make a record of a condition that has been immediately corrected. But, it would be a best practice to document that hazard and it’s correction. If you find an issue that cannot be immediately corrected, record the hazardous condition on your examination form. If you are a miner performing the exam, notify your supervisor.

8 3. Promptly notify miners in affected areas if adverse conditions are found and not corrected before miners are potentially exposed.

9 Prompt notification of hazards
If you find a potential hazard and cannot correct it immediately… You must: - Immediately notify anyone that might come into the area, this can be done by: -Telling them (however, you must be able to document that you told them) - Put up signage or a barrier/barricade. Record the hazard After the hazard is removed, you must record when hazard was abated on the original record.

10 4. Withdraw all persons from affected areas when alerted to any conditions that may present an imminent danger, until the danger is abated: If it is a potentially immediate danger to anyone, you must make sure that no one is allowed in the area until the hazard is removed.

Make a working place examination record before the end of the shift for which the examination was conducted Make sure the workplace exam includes: - The name of the person conducting the examination - Date of the examination - Location of all areas examined - A description of each condition found that may adversely affect the safety or health of miners that is not promptly corrected - The date when the described condition is corrected. (If the condition exists during more than one shift, it does not have to be recorded each shift)

12 Workplace Examination Record Keeping
Records must be kept for review for 1 year Electronic records are acceptable as long as they are secure Records must be made available to MSHA, Miner’s Rep, upon request

13 If you have a Contractor working in an area for more than one day…
For Example: - Contract driller/blaster/stripping crew - Machinery repair - Anyone Building or installing equipment Any contractor MUST complete their own workplace exam, unless they are working in the same area as your employees. Their workplace exam must be turned in to your company also at the end of the day, week or job completion.

14 New Ruling Recommendations
Discuss changes and what is expected of miners in a safety meeting setting and make record of it. Refresher task training on miners of workplace examinations and make a task training record of the training. Ask your local MSHA area office for additional support and compliance information materials.
