3 Background 1. Increasing Demand of Adjudicators
MDBs started to use FIDIC MDB Harmonized edition in JICA adopted MDB Harmonized edition for Works contract in 2009. JICA’s other Standard Bidding Documents including Plant works and Small Works also use Dispute Board/adjudicator since 2010. Trend to move from ad-hoc DB to standing DB in design build contract? 3

4 Background 2. Insufficient numbers of adjudicator to cope with increasing demand FIDIC President’s List - 47 adjudicators - only one Asian adjudicator (Prof. Toshihiko Omoto) - assessment at about 3 years interval FIDIC encourages its Member Associations (MAs) to establish their own National Lists*. Note : List of Adjudicators established by each FIDIC MA is called National List. 4

5 Preparation 1. AJCE’s Internal Arrangement
Establishment of Adjudicator Committee 1) Initiate realization of adjudicator AJCE List 2) List up necessary preparation works and draft action plan 3) Collaboration with FIDIC Drafting Rules on Adjudicators 1) Rules provided for necessary procedures for AJCE to prepare AJCE list of adjudicator under FIDIC contracts ("AJCE List"). 2) Adjudicator Assessment Procedural Rules 3) Adjudicator Registration Procedural Rules 5

6 2. Adjudicator Assessment Procedural Rules
Purpose Applies on the procedure for assessment of candidate for adjudicators under FIDIC contracts conducted by AJCE Contents 1) Establishment of Assessment Panel 2) Announcement in public - 6 months prior to the Assessment 3) Documentary examination 4) Training and Workshop (FIDIC Modules 1, 2, 3 and 3A) 5) Reporting results 6) Others: Fee, Miscellaneous Provisions, Revision and Repeal Annex: Adjudicator Assessment Application Guidelines 6

7 3. Qualification Criteria
FIDIC Qualification Criteria AJCE Qualification Criteria Member of FIDIC MA No limitation Professional Qualification PE, First-class architect, First-class Manager on Civil Works, Attorney, In-house legal experience Experience in Industry More than 10 years in CE/ Construction Industry Experience in Oversea Projects AJCE requires experience in international construction works, Knowledge on FIDIC Documents experience in working with FIDIC documents, and experience in Experience in Dispute Resolution resolution of contractual disputes Assessment Workshop FIDIC Module 3 and 3A (Module 1 and 2 are prerequisite) Communication Skill To be fluent in English Availability upon Appointment Essential requirement Impartiality Others Intention to Register on AJCE List 6

Purpose Applied for judging capability of successful applicants who could be listed on AJCE List, and for the procedure for registration and the renewal of the AJCE List. Contents 1) Operation of AJCE List 2) Requirements and Application for registration 3) Confirmation of applicants for registration 4) Term of registration 5) Renewal of registration (re-registration): CPD record required 6) Others : Fees, Deletion, Disclaimer, miscellaneous provisions, Revision and Repeal 8
