Copyright Legislation Copyright Act 1968 – balance between rights of owners and access by consumers Statutory Licences (Part VA, Part VB) - Copy and communicate for Educational Purposes to teach students enrolled in courses at the University Make available to students as part of a course of study at the University Put a copy in the University Library or elsewhere as a teaching resource administration of students and courses Part VB – print and graphic material Part VA – broadcasts (radio, television, cable, satellite) Moral Rights Act 2000 Rights of creators of copyright works

Part VB (Print and graphic material) Periodicals - 1 article per issue of a periodical – or more if they are all on the same specific subject NOTE: usually doesnt include material available under subscription or through other licences – check the licence or subscription conditions. Anthologies - 15 pages Incidental artistic works – (graphs and illustrations which explain or illustrate the text (graphs, pie charts) and artworks already in electronic form Artistic works – in hardcopy if NOT separately published Other works (eg. books) - 10% or 1 chapter, whichever is greater Part VA (Off-air broadcast) Copy off-air broadcasts from Radio, Cable, TV, Satellite Copy downloaded podcasts of broadcasts You cannot copy commercial videos/DVDs Statutory Licence Limits

Yes - BUT you must restrict to UNSW only Must use EUN Mark analogue tapes of the off-air broadcast with details of program, channel, date and time. A lecturer wishes to place an article she had published in a journal several years ago on the school website so that it would be accessible to students and other interested parties. No commercial benefit will accrue to her as a result of making the article available. Can she do this? This can only be done with permission of the copyright owner which is probably the journal publisher. Copyright Scenarios

A lecturer wishes to include an article he has written and published in a journal in his UNSW Olive / Moodle online course materials. Can he? No. Lecturer must link to the article if online, or if in print, send the article to the Course Reserve Collection service. An electronic use notice will be attached and a link can be made from the Olive / Moodle course to the article in the Course Reserve Collection. Copyright Scenarios

A lecturer wishes to include a number of videos in online and CD-ROM courseware for students who will be off-campus. These videos were purchased commercially and placed in the University Library where they are available for students to borrow. They are also shown to students in lectures. Can these videos be digitised onto CD-ROM and included in the Olive/Moodle courseware as streaming video? No. The material cannot be copied under the Part VA licence as the programs have not been broadcast. Check the Copyright statement on the video to see what is permitted. Copyright Scenarios

I am writing a series of lectures which I wish to use in my online course. There are several illustrations which I usually show when I'm giving the lecture. Is it okay to scan these from the books and include them in the lecture materials in my Olive/Moodle course? I will cite the source of the illustrations. Yes, provided the website is restricted to students and staff of UNSW, the source is cited and an electronic use notice is seen by the students before or at the same time as the illustrations. Over the years I have written many course notes to support my teaching. Many students have told me that they found these notes to be of great interest and value. I use many illustrations, such as diagrams and even art works, to illustrate the important concepts. I consider this valuable body of work should be available to the scientific community, including current and prospective students and school teachers. Can I place these on the Faculty website? No. Permission would be needed for every single illustration before the notes can be placed on an open website. Copyright Scenarios

I was concerned to hear that a particularly useful book which I have referred students to for several years is now out of print and no longer available. As the book is valuable I would like to make an electronic copy of the book and to make this available to students via links from my Olive/Moodle courses. Can I? This can be done provided that the lecturer: Has a letter from a retailer (such as the University Bookshop) confirming that the book is out of print, and Has written indication from the publisher that the book will not be available within a reasonable time (say 6 months) at an ordinary commercial price. I have recently purchased a DVD copy of a film on which I wish to write a critical article. I would like to make some still images from the film to use as illustrations for the article. This seems to me to fit within the Fair Dealing provisions so I don't think there are any copyright hassles. I won't be publishing the article for commercial gain. Still copies can be made for purposes of study, research, criticism and review (fair dealing). Permission from the copyright owner would be needed to publish the stills in a journal article. A PhD student is going to publish their Thesis online in the UNSWorks. The thesis contains third party copyright material, such as text, artistic works, and some musical notation. Can the student make the thesis available online? Yes. Provided the student has obtained written permission from the copyright owner(s) for the third party material. Copyright Scenarios
