Training is required for any supervisor of “Covered Service Employees”

Covered Service Employee
Federal Railroad Administration Hours of Service Employees Employees performing a duty normally performed by an hours of service employee Federal Motor Carrier Safety Administration Employees performing a driving job that requires a Commercial Drivers License (CDL)

Federal Rule 1. Prohibits alcohol or drugs on you or in you while you are performing in a covered service position.

Prohibited Substances
1. Alcohol 2. Marijuana 3. PCP (Angel Dust) 4. Amphetamines 5. Opiates 6. Cocaine

Reasonable Suspicion Reasonable person, having had this training, observes SPECIFIC, ARTICULABLE, CURRENT behavior that could indicate that the employee has used alcohol or another prohibited substance.

Reasonable Suspicion Criteria
General behaviors that indicate a person may have used drugs or alcohol. Though these behaviors may or may not be caused by substance use, they constitute reasonable criteria to test for Drugs and Alcohol.

Reasonable Suspicion Behaviors
A supervisor observing any ONE of these behaviors is REQUIRED BY FEDERAL LAW to have the employee tested for alcohol or drugs or both.

Observation of Employee using
Drugs or Alcohol Staggering gait or difficulty walking and maintaining balance Slurred speech Drowsiness or sleepiness Odor of intoxicant (alcohol or marijuana) Disoriented (to time, to place, to person)

Observation of Employee using
Drugs or Alcohol Rapid mood swings, example: Going from happy to angry, happy mood to sad or crying mood or vice versa in seconds with no apparent reason for the mood change Poor coordination or body control Bizarre behavior

Employees suspected of ALCOHOL USE:
FRA & FMCSA One Supervisor can make the determination that the employee is exhibiting reasonable suspicion behavior.

Employees suspected of DRUG USE:
FRA - Two Supervisors must agree that the employee exhibits reasonable suspicion behaviors. One supervisor must have had this training. Second supervisor does not have to be at the scene, can be contacted by phone. FMCSA - One supervisor who has had this training can determine that the employee is exhibiting reasonable suspicion behavior.

Reasonable Suspicion Procedures
A) Reasonable Suspicion determination is made to test. 1. Inform suspected Employee’s as follows: “Determination has been made that there is reasonable suspicion that you may have used alcohol or drugs and you are ordered under company and/or U.S. Department of Transportation Authority to undergo testing as directed”

Time and Place of incident Who was supervisor that made observation? What was reasonable suspicion observation? If drugs - who was supervisor who confirmed observation. Was confirmation done telephonically or was confirming supervisor on site? What actions did you take? What actions did the employee take?
