Stabilisation and Association Agreement between the European Communities and their Member States and the Republic of Montenegro from 2007 year effective from 1 January 2008 year
Protocol 4, Article 61 of the Agreement lays down the rules applicable to the relationship between the parties, particularly, unrestricted road transit traffic through Montenegro and the Community as a whole, the effective application of the principle of non-discrimination and progressive harmonization of Montenegrin legislation with the legislation of the Community

Transport Development Strategy of Montenegro, adopted in July 2008 provides general guidelines for the development of transport in Montenegro
Basic goals of strategic development of Montenegro’s transport system are as follows:

Integration in the European Union, through connection to TEN-T and improvement of competitiveness of national transport economy

Montenegro through representatives on the Steering Committee, in accordance with Memorandum of Understanding for the development of the Core Regional Transport Network (MoU) and participates actively with the mediation South East Europe Transport Observatory (SEETO)
SEETO Comprehensive Network was included in the TEN-T Comprehensive Network in the year of 2011
There is currently Establishing a Transport Community Treaty (TREATY) was drafted and is now in the process of harmonizing, which is a continuation of activities undertaken through MoU

SEETO Regional Cooperation plays a vital role in the process of transport system development in the South East Europe focusing not only on infrastructure development but on horizontal measures as an integrated part of the system as well
Development of the SEETO Comprehensive Network up to the TEN-T standards and further integration of the South East European Transport System in the European remains a prevailing goal of the cooperation

Thus, the SEETO Comprehensive Network Development Plan 2013 is made based on the requirements stated in the MoU as well as on the main needs addressed by the Regional Participants the European Commission and the Financial Institutions that jointly participate in the SEETO Cooperation
Horizontal measures analyzed in correlation with proposed SEETO strategic projects are addressed in the final chapter of the document together with proposals for overall improvement of the transport system in the South East Europe

TREATY contains several main goals:
The creation of a Transport Community in road, rail, inland waterways and maritime transport, as well as the development of the transport network between the European Union and the Party JIE. Transport Community will be based on the gradual integration of the transport market in the EU transport market based on relevant EU acquis, including the field of technical standards, interoperability, safety, security, traffic management, social policy, public procurement and the environment, on all traffic, except air traffic

2. General functioning of the Transport Community, hereinafter referred to as the "Basic Agreement“
Railway undertakings licensed in one EU Member State, or by a South East Europen Party shall have the right of access to the infrastructure in all the EU Member States and South East Europen Party for the purpose of operating rail passengers or freight services.

Air transport:
Law on Air Transport (Official Gazette of Montenegro. 30/12) The new law is fully defined in the Montenegrin flying airspace, aircraft registration in the Register of Aircraft Montenegro, airspace management, safety and security of air transport, conditions of use and performance of airports and airport services, and the investigation of accidents and serious incidents. Great attention is paid to the security and safety of civil aviation, in accordance with the legislation of the International Civil Aviation Organization (International Civil Aviation Organization-ICAO) and legislatives European Union in this field.

Support for the implementation of investment
The Government of the Montenegro budget for year year for maintenance of the railway infrastructure allocated million EUR
