Weak Project Management by CDC
Project Review Weak Project Management by CDC Evolved versus master plan Failure to obtain advance regulatory approvals Including permits, zoning, fire, environmental Failure to confirm property lines and easements Inconsistent management oversight Issues surfaced from the 1999 decisions What appeared simple became very complex
10
Project Review How did we respond?
-We remained part of the solution, consistent in our requirements with Varadero interests the priority -property, safety, privacy, liability, security (pop in n out) -required and monitored corrective action on CDC violations, however identified -sought legal advice when appropriate -Thorough coordination with ALL players -help from our neighbors in and around Varadero -three phases to the project…
11
Phases Going Forward Phase 1: Restore Varadero property
Phase 2: Restore the original “picnic grounds” Phase 3: Glamping Sites Still requires: -Building permits (bullet)-zoning change -major use permit -flood plain determination -biological easement breach. -trespass on bio easement & Varadero property Boom animation

The Memorandum of Understanding
Agreed upon approach to get from here to there -remain within regulatory guidelines and Varadero CC&R's and bylaws. -Not a legally binding agreement
14
The Memorandum of Understanding
-Varadero security, liability, noise, privacy, fire safety, habitat and property rights protected -Primary interest to reestablish “picnic grounds” -No project related liability to Varadero -No project related costs to Varadero
15
The Memorandum of Understanding
-CDC to correct all open space violations -Amend current or create new lease -CDC complies with all regulatory requirements -New Pavilion Needs Varadero Support
16
The Memorandum of Understanding
CDC to resolve all regulatory glamping issues -zoning, flood plane, bio easement, building permit and major use permit -about 6 months, probably 12 plus -a real long shot per the County Then and Only Then… Come to Varadero with a glamping master plan and a proposal to address their trespass Arrange like slide 11
