The Election of 1800 Federalists: John Adams for President and Charles Pinckney for Vice President (Democratic-)Republicans: Thomas Jefferson for President and Aaron Burr for Vice President How was this election different than elections today? Adams and Jefferson did not travel around the country to gain support They sent letters to citizens and newspapers to make it clear what their views were How was this election similar to elections today? Each side made personal attacks ( Federalists accused Jefferson of being “godless” because he believed in Freedom of Religion Republicans warned that Federalists only wanted the rich in power and would bring back a monarchy

The Vote is Tied At the time, electors casted two ballots without indicating which was for Pres or VP Person with the most votes won Pres and second most votes won VP In 1800, 73 electors voted for Jefferson and Burr A ties meant that the House of Representatives had to decide the election In the House, Federalists all voted for Burr making it a tie again until one Federalist decided not to vote for Burr. To stop a tie from happening again: 12th Amendment was passed in 1803 Each elector would cast one vote for Pres and one vote for VP

Jefferson’s Inauguration
President Adams did not attend Jefferson’s Inauguration He wore everyday clothes, very informal His speech outlined his goals: A wise and frugal government Supporting states’ rights Limit the power and size of the federal government

The Growing Power of the Supreme Court
William Marbury Appointed to the courts but did not receive a commission He asked Supreme Court to force its delivery Supreme Court said it did not have jurisdiction (the legal authority) Marbury v Madison established three principles of judicial review The Constitution is the supreme law of the land The Constitution must be followed when there is a conflict with any other law The judicial branch can declare laws unconstitutional
