Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung Reasons to have a closer look Hessian Government intends to implement a noise limit for the Frankfurt Airport to limit noise in the future (Noise limit shall ensure that noise level will be lower than anticipated in 2007 for full enlarged capacity when decision for forth runway was taken) Quite a number of letters from citizens and citizens organisations fearing that Hessen must take back the night flight ban introduced in 2011 in Frankfurt due to the regulation Questions from Parliament on the ratification of the bilateral agreement on aviation EU/USA which contains partly similar stipulations as the Regulation 20 November 2015

Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung State of play in Frankfurt – Operations Restrictions Night Flight Ban was introduced in 2011 (together with the start of operating the new runway) No scheduled flights from 23:00-5:00 local time Maximum of 133 scheduled flights from 22:00 – 6:00 local time (average per night / year) Exceptions for landings: Possible until 0:00 local time, but not more than average of 7,5 per night / year Exceptions for take-offs: Only possible if the reason for delay could not be influenced by airline, needs prior permission by HMWEVL Exceptions for special cases (Medical, safety etc.) Only Chapter 4 Aircraft 20 November 2015

Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung State of play in Frankfurt – Land Use Management Since around 2000 a large zone has been defined where no new zoning for housing is allowed (legally binding; implemented in regional land use plans) 2011: Implementation of Noise Protection Area according to the national Noise Protection Act: No new housing allowed; restrictions for hospitals, schools etc. Insulation of houses and appartments; Fraport has to fund measures Additionally: “Regional Fund” installed by Hessian Government to additionally provide help for citizens severely affected by noise 20 November 2015

Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung The ICAO Balanced Approach as main requirement of Reg. 598/14 EU-Regulation 598/2014 reinforces the ICAO “balanced approach” regarding the implementation of noise-related operating restrictions. No novelty: EU Member states = members of ICAO Directive 2002/30/EC already referred to the “balanced approach” 20 November 2015

Regulation No 598/2014 does not prevent Member States to implement noise abatement measures. However, it introduces a set of procedural rules which the Member States have to comply with when considering noise abatement measures, especially operating restrictions. 20 November 2015

Principle of proportionality:
Hessisches Ministerium für Wirtschaft, Energie, Verkehr und Landesentwicklung Germany has a very similar, legally binding rational in administrative law which covers the requirments of the balcanced Approach: Principle of proportionality: State may not affect the rights of a person or company without adhering to this principle: - measure must be able to sucessfully address the problem which shall be solved measure must be the mildest interference with existing rights to reach the solution of the problem if several options exist Measure must be proportionate 20 November 2015

ICAO’s standards and instruments are not the sole measures for States to resolve conflicts on the subject of aircraft noise (e.g. operational restrictions at Frankfurt Airport) We will be able to implement the Regulation 598 with some additional administrative burden, but no limitation regarding the content of possible operations restrictions if we adhere to the principle of proportionality Donnerstag, 4.
