15 Question analysis Question number 32: The principle appended in the question provides for rule of strict liability of a person non natural use of land and escape of the substance from the escape. Act of God is a defence in strict liability. The principle further provides for rule of absolute liability upon a defendant engage in inherently dangerous activity. However act of God is not a defence to rule of absolute liability. Facts in the present question are that a reservoir containing mild acid was fractured when a thunderbolt struck it. This reservoir belonged to X. Reservoir broke and the herbs of Y’s garden were destroyed. Y sued X for absolute liability. After the chemical examination it was found that the acid was not harmful. X in the case claimed the defence of Act of God. Answer: The correct answer in this question is option (B). The principle provides that that for rule of absolute liability inherently dangerous activity is required. The chemical examination revels that the acid was not harmful proving that no inherently dangerous activity was involved and rule of absolute liability is not applicable in this case. But there was a non natural use of land and hence Act of God is patently available to X. Y therefore will not succeed.

16 Question analysis Question number 48: There are two principles in this question. Principle 1 provides for the liability of dishonour of cheque when the cheque is returned unpaid for insufficiency of funds. Principle 2 on the other hand provides that for the dishonour of cheque by a company all the directors of the company shall be deemed to be guilty of the offence and shall be liable for prosecution. Facts provide that X and Y were the directors of a company. Y decided to avail a home loan and issued one cheque drawn on IHIC Bank from his corporate bank account as security advance. This cheque was dishonoured for lack of funds. The Bank IHIC Bank filed a complaint against X as wekk as Y. Answer: The correct answer in this question is (A). The reason for this is that firstly the loan was availed by Y from the corporate bank account and there was a dishonour of cheque with respect to the same account. The second principle provides that all the directors will be collectively responsible in case the company commits it. Since both X and Y are directors, hence both of them are liable for the offence of dishonour of cheque.

17 Question analysis Question number 45: Principle provides that State Recognition signifies that the decision of a sovereign state to treat another state to treat another entity as also being a Sovereign State. This recognition of the state can be either express or implied. Facts: The facts in the present question are that East Timor was to secure the membership of the United Nations. In 2010, India organized the Asian Games 2010, which was attended by 42 nations which included East Timor as well. In 2013, East Timor opposed the resolution moved by India in World Trade Organization and resultantly the resolution fell. India further moved a resolution in the United Nations for rejection of membership of Easy Timor. Answer: The answer in this question is (A). The reason for this being that by inviting the teams of other States along with their Heads, India impliedly recognized the existence of East Timor. From the principle it is clear that the recognition of the State can be express and implied. Recognition of East Timor was implied.
