Homicide The killing of one human being by another The most serious of all criminal acts

Criminal Homicide First Degree Murder - Committed with Malice (having intent to kill) and premeditation Felony Murder – Any killing that takes place during the commission of certain felonies (i.e. rape, burglary) Most states consider this first degree murder even without Premeditation or malice

Criminal Homicide Second degree murder - Committed with malice but without premeditation Voluntary manslaughter – Occurs after the victim has committed an act that would cause a reasonable person to lose self control(Heat of passion). Cannot be provoked by words alone. Must occur before a “cool down” period.

Criminal Homicide Involuntary manslaughter – No intent. results from reckless conduct (i.e. playing with a gun known to be loaded) Negligent homicide – Failure to exercise reasonable or ordinary care, causing death
