Common assault: assault and battery. Offences Against the Person Act 1861: actual bodily harm; wounding and grievous bodily harm; wounding and grievous bodily harm with intent. Tip: When looking at scenarios we always start with the highest possible offence. If we can’t make out the AR & MR then we ‘drop down’ to the next offence. Look at the flow chart on p.203 so that you know where to start

For each scenario, identify:
I - which offence/offences may be present. R – State the AR required (with authority) A – Apply the law to the facts C – Conclude whether AR is established And then… R – State the MR required (with authority) C – Conclude whether MR is established n.b. if you are not satisfied that AR & MR are present then drop down to the next offence…
