Law: Chapter 1 – Values in Lawmaking How do values play a role in developing law?

Jurisprudence: This is the study of law and legal philosophy Created and enforced by government – regulations of a society Need for laws is in every society Are all fair – NO!!! For the law to succeed a society must buy into the system of the rule of law idea to support the laws and obey them or really the law is no good Is any one above the law? NO

Laws reflect a societys values or morals (ex. Killing is wrong so murder is against the law) Not all immoral things are illegal (ex. Lying to friends) GOALS: -Protect human rights -fairness -resolve conflicts -order -behavior (soc/econ) -will of majority -rights of minorities

Moral Values problems in society is the idea of conflicting with achieving these above goals ideal situation is to achieve some kind of balance within all of the goals CHANGE CAN HAPPEN!!! (morals and laws) Killing (self defense – war time) *abortion* this is a sticky issue with study of law

Economic Values Tax breaks for homeowners Discourages shoplifting Political Values Vote – encourages citizenship

Social Values Promoting free education for students School sports – Title IX (sports programs for girls) Can you pass a law to solve all of your problems? NO (18th amendment – prohibition) What is a reasonable requirement for what a law should or could do? Homework tonight: problem 1.2
