From our Legal Office we have Staff Counsel Deborah Dyer (if she is able to attend). From our Siting Transmission and Environmental Protection Division we have Christine Root, Compliance Office Manager and myself, Mary Dyas, Compliance Project Manager. And from our Facility Design Unit we have Shahab Khoshmashrab. Now we’ll go around the room and have a representative from each entity introduce themselves. (only do this if we have a small group)

CBO Authority / DCBO The Energy Commission is the Chief Building Official (CBO) and has the responsibility of enforcing the California Building Code. Authority to delegate to either a local building official or an independent third party. The Delegate CBO represents the Energy Commission: Engineering plan review and on-site inspections. Staff retains CBO authority: Interpretation and enforcement of state and local codes. CHRISTINE For all energy facilities certified by the Energy Commission, the Energy Commission is the Chief Building Official (CBO) and has the responsibility of enforcing the California Building Code (CBC). Under CBC section 104.2, the CBO is authorized and directed to enforce all the provisions of the CBC. The Energy Commission has the authority to delegate CBO duties to a local building official or an independent third party. The Delegate Chief Building Official (DCBO) represents the Energy Commission as the site engineering inspection representative, performing engineering plan review and on-site inspections. However, staff retains CBO authority including the interpretation and enforcement of state and local codes.

DCBO Pre-Bid Conference
The Stanton Energy Reliability Center (SERC) will be a nominal 98-MW natural gas-fired EGT plant consisting of two GE LM6000 PC natural gas-fired combustion turbine generators and related facilities, with integrated batteries for hybrid operation and clutch gear for synchronous condenser operation. Project elements include the generation equipment, battery array, and connections to natural gas, municipal water supply, and the electrical grid. MARY and project owner to discuss the project and the current status. The Stanton Energy Reliability Center will be a nominal 98-megawatt natural gas-fired Electric Gas Turbine plant consisting of two General Electric LM6000 PC natural gas-fired combustion turbine generators and related facilities, with integrated batteries for hybrid operation and clutch gear for synchronous condenser operation. I will let the project owner describe the project in more detail.

DCBO Pre-Bid Conference Key Items Tobe Aware Of
Zero Sum Contract Winning firm will contract directly with Project Owner for payment after completing negotiations with the Energy Commission. Rates will be negotiated through the Energy Commission Process. Contract cap will be negotiated by the Energy Commission and will be based on information provided by the project owners and our needs. Third Party Beneficiary Agreement (Attachment 10) CHRISTINE This is a zero sum contract and no money will pass between the Energy Commission and the selected DCBO Firm. The winning firm will be required to enter into a separate contract with the project owner for payment. This contract is required to be a Time and Materials contract with rates and a contract cap set by the Energy Commission. The Energy Commission will negotiate rates with the top selected firm as described in the RFQ. Staff will also prepare a level of effort/hourly budget with the project owner based on our needs on the project. With these two pieces of information staff will establish the contract cap that will apply to the contract between the project owner and selected DCBO firm. DCBO firms should be aware of the Third Party Beneficiary Agreement that is required to be in the contract with the DCBO firm and the Project owner. This is Attachment 10 in this RFQ.

The minimum requirements in this RFQ include: Certification Regarding Conflicts of Interest which will be covered in the next slide, and (2) The Project Team Minimum Requirements Form (which is Attachment 11 in the RFQ package).

CHRISTINE Part 1 - Most DCBO firms are not likely to work for a project owner during the application phase, but if you have, you would disclose this by checking yes. Working for a project owner during the application phase for a project is a conflict of interest for this contract. The Commission does not want firms who worked for the project owner during the licensing phase to represent us when we are overseeing the construction of a project. Part 2 - If your firm has worked for a project owner listed on pages of the RFQ in the last 12 months outside of the scope for an old project MOU you would check yes. You would then disclose the companies that you have worked for in the line items below. Again if you worked under an Energy Commission MOU and had a contract with a project owner listed on page 22 of the RFQ, then this would not apply to you and you check no. It is only when you worked for a project owner in the 12 months on the list that was outside the scope of an MOU that you would check yes. Checking yes in this section of the COI for indicates that you have a conflict of interest. Ideally we want to see “no” checked for both item 1 and 2 in the form when it is certified.

MARY For each expertise or position listed in the Project Team Minimum Requirements table, Table 1 in the RFQ package, each Firm must submit the name of the team member, a short description of the person’s qualifications; experience; education, license, or certification, and a copy of those licenses and certifications. The Firm must have at least one team member for each of the delegated positions with at least the minimum qualifications, experience, and education as identified in Table 1. The firm must identify at least one name for each position in Attachment 11. This is pass/fail. If the Firm fails to satisfy all of the Project Team Requirements at the time of the SOQ submission the Firm will be eliminated and the SOQ will not be evaluated and scored.
