Open with the work that has been done to date and the process we have used for engagement as well as the engagement that has occurred once the rules where promulgated. (have a reference document and PP from ELC)
We have received XXXX public comments across all types of care. We are having a public hearing on May 15th at 6pm in Salem and the public comment period is extended to May 21st. For people who cannot attend the public hearing they can definitely send written input. It think it is important to note that all public input is being reviewed, there isn’t a difference verbal versus written. Staff has been reviewing all the public comment to date and have been meeting weekly to review and incorporate changes.
What the requirements are and how we met all of the requirements are…
These rules will be brought to the ELC on May 31 for adoption. What we are bringing to you today are the areas that have received the most public comment and are looking for your policy guidance.
The areas we will be discussing is Safe Sleep and Swaddling, School-Age Definition, Training Requirements for all 3 types of licensed care. Because you have served for the last 18 months we wanted to bring this back to you

Why We Are Revising
The existing child care rule sets were developed separately resulting in various differences among the type of care
To better align with best practices (Caring for Our Children)
Align with statute: HB 4065 (2018)
Allow the OCC to take action when a license expires
Protect children from providers who have had previous significant licensing violations
Grant OCC the ability to issue cease and desist orders and level civil penalties against illegal care
Increase civil penalties allowed in statute
Allow the OCC to impose conditions on licenses

3. Safe Sleep and Swaddling

Safe Sleep and Swaddling
Draft Rule Language Public Comment Summary
Swaddling or other clothing or covering that restricts the child’s movement is prohibited. (CC, CF, RF, RS)
Loose-fitting sleep sacks that do not restrict movement should be allowed. [Quote from the AAP 2016 guidelines]
Infants should be allowed to be swaddled until they are able to roll over.
Swaddling or wearable blankets can be culturally appropriate and a safe, soothing mechanism to help young infants sleep.
Caring for Our Children states that swaddling is not recommended or required, but it doesn’t prohibit it.

Stepping Stones to Caring for Our Children: National Health and Safety Performance Standards: Guidelines for Early Care and Education Programs
Swaddling infants when they are in a crib is not necessary or recommended, but rather one-piece sleepers should be used.
