Local Government Seminar January 31, 2019 Laws You Didn’t Know Existed Things That Need to Be In Your Personnel Policy Loren B. Smith, Attorney

2 Emergency Personnel All personnel should be designated in the personnel manual or in your emergency management plan if they are required to be on site or on call during an emergency. If in the emergency management plan, be sure you can document the employee’s knowledge of that information. Also, be sure that your provide that your exempt employees will receive overtime during an emergency. This will enable you to get a FEMA reimbursement.

3 Harassment Be sure that your harassment policy prohibits all types of harassment, not just sexual harassment. Check your reporting procedures for harassment – designate specific individuals for reporting, not just “your supervisor.”

4 Nepotism Include cohabitation in your nepotism policy.

5 Absence Control Policies
Be careful – the ADA requires that your provide “reasonable accommodations” – 180 days may not be reasonable.

6 Guns In the Workplace Must have exception for guns locked in personal vehicles in the City parking lot if the individual is licensed to carry a gun

§ Definition In this chapter, “public employer” means: (1) a county, a municipality, or another political subdivision of this state, including a school district

§ Right to Express Breast Milk An employee of a public employer is entitled to express breast milk in the employee’s workplace.

§ Policy on Expressing Breast Milk A public employer shall develop a written policy on the expression of breast milk by employees under this chapter. A policy developed under Subsection (a) must state that the public employer shall: (1) support the practice of expressing breast milk; and (2) make reasonable accommodations for the needs of employees who express breast milk.

§ Public Employer Responsibilities A public employer shall: provide a reasonable amount of break time for an employee to express breast milk each time the employee has need to express the milk; and provide a place, other than a multiple user bathroom, that is shielded from view and free from intrusion from other employees and the public where the employee can express breast milk.

§ Discrimination Prohibited A public employer may not suspend or terminate the employment of, or otherwise discriminate against, an employee because the employee has asserted the employee’s rights under this chapter.
