2 Establishing National Supremacy
Implied Powers – McCulloch vs. Maryland (1819) ruled Congress has implied powers in addition to its delegated powers and that the Federal Government is supreme over State Governments. Commerce Power – Gibbons vs. Ogden (1824) said trade between states is regulated by Federal Govt. Also it defined commerce very broadly to encompass virtually every form of commercial activity.

3 National Supremacy Civil War – How did Southern states claim sovereignty in the Civil War? Claimed States rights – right to rule themselves Militarily the natl. govt. asserted its power over the Southern states’ claim of sovereignty. Struggle for Racial Equality - How did the Supreme Court assert natl. supremacy concerning racial equality? Brown v. Board of Education (1954) outlawed segregation in the public schools. Compare enforcement of the major civil rights legislation of the 1960s and 1970s to the enforcement of the 13th, 14th, and 15th Amendments during Reconstruction and later periods.

4 Supremacy 1963- Alabama Governor George Wallace made a stand at the Univ of Alabama to resist integration of the all-white school. Federal marshals won this confrontation & since then Fed. Govt. has been able to impose natl. standards of equal opportunity.

5 States’ Obligations to Each Other
Full Faith and Credit – Article IV, Section I of Const. requires each state to recognize the public acts, records and judicial proceedings of all other states.Examples? Marriage Equality – gay couples Driver’s License between states Extradition – Article IV, Section II of Const. requires a state to surrender a person charged with a crime to the state in which the crime was alleged to have been committed.

Privileges and Immunities – Article IV, Section II of the Const. requires states to give citizens of each state the privileges of citizens of other states
