Complainant files complaint in person or through online reporting system to one of the entities defined by an arrow Bemidji State University and Northwest Technical College Sexual Violence and Title IX Complaint Process Complainant, respondent Designated Officer notified. Supervisor & HR OR Dean of Students contacted for remaining concerns Campus administrator, supervisor, or responsible employee receives complaint & decides whether is 1B.3/ Title IX matter Designated Officer* receives complaint & conducts preliminary investigation No policy violation exists Decisionmaker* determines whether policy violation occurred A formal report is filed with Public Safety ( ) If yes, then Decisionmaker notifies complainant, respondent and Designated Officer. Sanction is implemented. No reasonable cause to proceed exists Reasonable cause exists Policy violation exits If no, then Comprehensive investigation occurs & report written Investigation is closed & complaint is notified Matter is referred to an appropriate campus resource Decisionmaker collaborates with Dean of Students for student respondent or supervisor and HR for employee respondent to determine sanction. Either party may appeal to President within 10 days to based on factors such as procedural error, new evidence or severity of sanction. Investigator notifies other party. President makes decision and notifies complainant, respondent & Designated Officer. Initial contact with Complainant must address Accommodations such as campus living space, work or class, No Contact directives, safety planning Medical exam – available regardless of report to police & up to 10 days post-assault – see Medical Protocol Advocacy with Support Within Reach Desired victim outcomes Other concerns Police Report. Whether or not a complainant wishes to report to police, the university must complete a separate investigation Shared information must be passed on unless shared with a confidential person * Sexual Violence includes sexual assault, non-forcible sex acts, dating and relationship violence, stalking, as well as aiding acts of sexual violence *Designated Officer: Title IX Coordinator – Deb Peterson, Deputy 315, , *Decisionmakers: Deans, Vice Presidents or Designee
