MDLs, TPLF, and Class Actions MDL Committee
Co-Chairs: Mary Massaron, Plunket Cooney Malini Moorthy, Medtronic Continue advocacy with the Civil Rules Advisory Committee’s MDL/TPLF Subcommittee process: Prepare written Comments as appropriate Organize members and allies to submit meaningful information to the Subcommittee Look for opportunities to host and/or participate in Subcommittee events Work with NERA and/or other researchers to conduct empirical research supporting LCJ’s advocacy for MDL rule reform Engage with congressional policymakers (in coordination with ILR and others) to: Educate about the need for MDL rulemaking Explore possibility of congressional hearings on MDL procedures Support congressional consideration of MDL, class action and TPLF reforms Monitor proposed Rule 23 amendments Provide programming for LCJ membership meetings Look for non-LCJ members with interest in this committee’s work and coordinate introductions to LCJ’s membership committee Coordinate with LCJ’s internal and external social media efforts to keep this committee’s members, LCJ members, and interested outsiders apprised of this committee’s goals and accomplishments

30(b)(6) Committee Chair: Brittany Schultz, Ford Motor Company
Continue engagement in Civil Rules Committee’s Rule 30(b)(6) reform process, including: Recruiting LCJ members and allies to testify at the Committee’s public hearings and to submit meaningful written Comments during the public comment period Preparing additional written Comments as appropriate at the conclusion of the public comment period Advocating with the Standing Committee as appropriate Identify and support state legislative/rule making activities aimed at reforming the equivalent of Rule 30(b)(6) in state courts Provide programming for LCJ membership meetings Look for non-LCJ members with interest in this committee’s work and coordinate introductions to LCJ’s membership committee Coordinate with LCJ’s internal and external social media efforts to keep this committee’s members, LCJ members, and interested outsiders apprised of this committee’s goals and accomplishments

Cost Allocation Committee
Chair: John O’Tuel, GSK Educate LCJ members, practitioners and judges about the need for incentive-based approach to discovery, including Rule 26(c) Foster innovative ideas and robust discussion of requester-pays rules, building on success of the Vanderbilt Symposium Drive thought leadership by producing work product on the problems of producer pays and solutions Identify important case law developments related to requester pays decisions Formulate ideas for future FRCP rulemaking advocacy Provide programming for LCJ membership meetings Look for non-LCJ members with interest in this committee’s work and coordinate introductions to LCJ’s membership committee Coordinate with LCJ’s internal and external social media efforts to keep this committee’s members, LCJ members, and interested outsiders apprised of this committee’s goals and accomplishments

Discovery Committee Chair: Robert Levy, Exxon Mobil Corporation
Identify, support and engage in state legislative/rule making activities concerning discovery reforms similar to the 2015 FRCP amendments, including Texas and Georgia Devise and execute strategy for engagement with the Civil Rules Advisory Committee on its current discovery pilot projects Collaborate with LCJ Cost Allocation Committee to advocate for requester-pays discovery Identify and engage in cases involving important issues related to the 2015 Amendments in which LCJ should file amicus curiae briefs Formulate ideas for future FRCP rulemaking advocacy Provide programing for LCJ membership meetings Look for non-LCJ members with interest in this committee’s work and coordinate introductions to LCJ’s membership committee Coordinate with LCJ’s internal and external social media efforts to keep this committee’s members, LCJ members, and interested outsiders apprised of this committee’s goals and accomplishments

Expert Evidence Committee
Chair: Abigail Dodd, Shell Oil Company Engage with Evidence Rules Committee’s Rule 702 Subcommittee process to: Prepare additional written Comment(s) if appropriate Organize members and allies to submit meaningful information to the Subcommittee if appropriate Find cases concerning Rule 702 interpretations in which LCJ should file amicus curiae briefs Identify and support state and local rulemaking efforts to reform expert evidence standards Provide programming for LCJ Membership meetings Look for non-LCJ members with interest in this committee’s work and coordinate introductions to LCJ’s membership committee Coordinate with LCJ’s internal and external social media efforts to keep this committee’s members, LCJ members, and interested outsiders apprised of this committee’s goals and accomplishments
