When we say “active entrepreneurs”, we imply business people, which are capable of producing competitive products and most importantly, entrepreneurs - that create new job places, bringing benefit not only to themselves and their families, but to the society on the whole. LEGAL STATUS OF THE COMMISSIONER FOR PROTECTION OF RIGHTS OF ENTREPRENEURS
1 The Commissioner exercises its powers autonomously and independently of state bodies, their officials and is accountable on its actions to the President of the Republic of Uzbekistan 2 The Commissioner on a systematic basis provides President of the Republic of Uzbekistan with an information on compliance of state bodies with the legislation on protection of rights and legitimate interests of entrepreneurs. 3 The Commissioner enjoys immunities and cannot be brought to criminal liability, detained, imprisoned or have administrative penalties imposed by courts without the consent of the President of the Republic of Uzbekistan. 4 On issues related to its activities, the Commissioner for Protection of Rights of Entrepreneurs enjoys the right of immediate reception by the public officials of state bodies and other organisations.

In the law-making sphere
Based on the enquiries and issues raised during the meetings with entrepreneurs, more than 50 proposals were made on improvement of legislation in the sphere of entrepreneurship. This led to the development of a Presidential Decree on “Additional Measures for Further Protection of Rights and Interests of Private Entrepreneurship, Improvement of Investment Climate and Business Environment in the Republic of Uzbekistan”. Reviewed and analysed drafts of 9 laws and 11 by-laws and provided relevant recommendations on them.

In accordance with the Presidential Decree, the so-called “tax amnesty” is envisaged, that is, cancellation of debts attributable to entrepreneurs and individuals. As a result, more than 475 billion soums were written-off and about 12,000 persons recovered their entrepreneurial activity.

Business Ombudsman is endowed with broad powers that ensure effective protection of rights of entrepreneurs 1 conduct examination of compliance and execution by state bodies of legislation in field of entrepreneurship; 2 declare in writing warnings to officials of state bodies about inadmissibility of violation of laws; 3 make submissions to the heads of state bodies on the elimination and rectification of revealed violations of laws; 4 apply to the courts with claims and enquiries on behalf of business entities;

To date, on restoration of violated rights of entrepreneurs by state agencies, Business Ombudsman has made: Response measures Quantity Submissions 42 Warning 18 Remarks Settlements in courts 10 (13 billion soums) As a result disciplinary actions taken towards 35 officials amounts returned to entrepreneurs 14,7 billion soums ensuring of allocation of loans 6,1 billion soums provision of land and buildings 11 business entities

Business - ombudsman reviews enquiries of entrepreneurs against decisions of state bodies and other organizations, actions (or inaction) of their officials that violate rights and legitimate interests of business entities. Complaints related to the resolution of economic disputes arising between business entities, disputes arising from family, labor and other legal relations not related to entrepreneurial activities are not included in the scope of competence of Business Ombudsman for the Protection of Rights of Entrepreneurs.

WORKING WITH ENQUIRIES
As a result of connecting “Eco-Style” LLC to the gas networks in Almalyk City, this enterprise that has over 250 workplaces started its manufacturing activities. Return of 156 million UZS as an overpaid tax amount to the enterprise with a foreign share “Mironov and Bubnov Invest” was ensured. Allocation of a territory to “Beck Mega Textiles” LLC for the construction of a factory for production of textile products in Sergeli District. On the grounds of violations of private property rights of “Eco Drip Lux” and “Egiz” companies by municipal authorities, the Commissioner has filled in two lawsuits, as a result of which court held to provide a refund and compensation to the companies in the total amount of 5 billion UZS (500 thousand euros). enquiries have been reviewed As of today 50.2 % - of which were positively resolved
