Who is responsible for the children?
Focus of FFA: Parent/Legal Guardian Caregiver with Significant Responsibility This will be in the PGs: Pervasive, day to day care and responsibility the child views such caregiver(s) as one of the primary persons with the authority for their care and the caregiver is expected to remain a part of the family unit OR The other household member or paramour residing in or frequenting the home has become a parent figure based on the: ASK how might you determine that a paramour has become a parent figure? observations of interactions between child/paramour child’s statements about the paramour statements from other family members or friends the child has a bond with the paramour, even though the paramour may or may not provide any financial support to the family. Multiple Families in Household
The family unit that the alleged maltreatment occurred in will be the focus of the FFA when: The families clearly function independently from each other. The two families may share some or all of the household expenses but do not have access to or combine family incomes. The children in each family do not view the parent(s) in the other family unit as having any responsibility or authority over their care. Some child care duties may be shared on occasion. One family, one FFA When two families reside together and share caregiving responsibilities, a separate FFA will be created for each family. CPI Case Practice Lab 1.1.7

What additional information is available to the CPI for investigative purposes? Local law enforcement records Florida Clerk of the Court (CCIS) FDLE Sexual Offender and Predator Website Out-of-State Child Welfare Records Florida Vital Statistics ACCESS Florida Information Is the CPI responsible for accessing these sources? They are not required in CFOP to have DAVID, CCIS, or Appriss accounts or to even obtain that information specifically. However its being provided by the Hotline to further assist investigative staff and some CPI’s also have direct accounts (varies by Region). In the past we have required that the FDLE Sexual Offender/Predator and DOC public websites be queried in CFOP and 65C-29 (if I recall correctly) though we would also hope that the information would be included in the FCIC/NCIC results. What would be the value to CPI for looking at any other these? (A brief sentence or two as to what information is in these sources would be helpful) System Usage D.A.V.I.D. Identity Verification, License Status, & Means to Locate CCIS Florida court case information to include some types of non-criminal case information such as citations, child support etc. Also, a means for obtaining dispositions when missing from criminal history records. Appriss Jail Booking Information on recent Jail Bookings (including images) for 42 States as well as for Florida. May be useful as a means to locate and/or obtaining status for specific subjects prior to updates to FCIC. *To me both CCIS and Appriss are ways to also obtain some local info that might not have been or may not will be uploaded to FCIC or in the local LE database. FDLE Sex Pred/DOC Public sites to me is just a way to ensure all records are obtained in the event they were not identified in FCIC/NCIC query. CPI Case Practice Lab

It can be opened for inspection by the individual, his/her attorney, a criminal justice agency and, in specific situations, a prospective employer. Criminal History Record Information provided by the Hotline CIU will be available via FSFN for 72 hours from the time the criminal history check was completed. The FSFN Q and J documents can be printed. The FSFN C and N documents cannot be printed. CPI Case Practice Lab

Improper Uses of NCIC/FCIC/DAVID
CPI submitting a request for purposes of Adoptions, Foster Care Licensing, Respite Care provider or Judicial Review Querying systems for anything other than investigations assigned (e.g. friend or family member, celebrity, etc.) Copying the information to keep in record Sharing information with any person not authorized CPI Case Practice Lab

Proper Documentation of Record Checks
“The appropriate background checks were conducted on (date) for (individual’s name). CPI has evaluated the information and reviewed for patterns of behavior or domestic violence that may pose potential safety concern or elevated risk of maltreatment to a child. At this time, (there appears to be) or (there does not appear to be) an immediate negative impact on the victim’s safety.” This is really helpful!!! CPI Case Practice Lab

Facts about Rap Sheets Florida and National Rap Sheets are similar
States may vary on the type of info provided and dispositions can be missing. To obtain a missing disposition the arresting agency or appropriate Clerk of the Court may need to be contacted. Rap Sheets normally contain: Type of Offense and Date Personally Identifiable Information (PII) Arresting Agency and Court Disposition Do they need to know anything more about “dispositions”? What do they mean? A disposition normally means a Judge’s ruling and/or a courts final decision on a lawsuit or criminal charge. In addition to the dispo definitions I’ve asked the Hotline if they have a list of common dispo abbreviations. CPI Case Practice Lab

“Hot Files” Person Files Files on persons to include Wanted, Missing Person, and Unidentified Person files. Status Files Are for informational purposes and include: Sexual Offender/Predator File, High Risk Sex Offender File, Probation or Supervised Release File, Career Offender File, Writs of Bodily Attachment, and Protection Orders. What is a writ of bodily attachment? They are civil writs entered by Sheriff Offices specific to failure to pay child support. What is difference between probation and supervised release? Both are sentencing options involving the monitoring of a person convicted of a crime. Probation is normally used as a sentence option instead of jail time while supervised release normally follows a period of incarceration. Will I be able to tell that my “client” is currently on probation? In most instances we should be able to identify if a subject is currently on probation. The actual criminal history charge may include that information in the court/disposition section. A Status Probation File may also be provided by the Hotline CIU (if located during the query). As with all data base searches there can be factors that can impact quality of the results (1) Was full and correct demographics known and used in the query (2) Did the staff member conduct the query correctly (3) Has the information been uploaded/updated in FCIC by the responsible Agency? *These factors are one of the reasons we also obtain locals and why its recommended to query additional data sources whenever possible and appropriate like CCIS or DOC. Briefly, what are protection orders? Will I know who is being protected? Do they expire? Protection orders are also referred to as injunctions. They may be permanent or temporary. If a protection order is found in FCIC the Hotline CIU will notify the CPI in the criminal history document. The timeframe of the injunction and who the order is against will be provided. Information specific to the protectee cannot be provided (per FDLE). . Local checks and CCIS are additional data sources that may provide information concerning protection orders. Criminal History Related Documentation in FFA
Based on review of criminal history information, there is a pattern of: Aggressive and violent acts towards intimate partners (or children, or family members, etc.) Substance use that has resulted in legal consequences Criminal behaviors and charges resulting in incarcerations A pattern of behavior that is increasing in frequency and severity CPI Case Practice Lab
