3 Equality Delivery System 2
The Equality Delivery System was refreshed by NHS England (EDS2) to provide a streamline performance tool kit for NHS Organisations to help identify and improve the NHS’s performance for people from protected characteristic groups.

4 At the heart of the EDS2 are 18 outcomes grouped under four Goals
1) Better Health Outcomes for all 2) Improved Patient Access and Experience 3) Empowered engaged and included staff 4) Inclusive leadership at all levels The Goals/Outcomes were strengthened to help the NHS deliver on (for example) The NHS Outcome Framework, The NHS Constitution, CQC Inspection Key lines of Enquiry, NHS Contract, legal duties etc…

5 Legal Duties Under the Health and Social Care Act 2014, Clinical Commissioning Groups must in the exercise of their functions, have regard for the need to: (a) Reduce inequalities between patients with respect to their ability to access health services, and (b) Reduce inequalities between patients with respect to the outcomes achieved for them by the provision of health services The Public Sector Equality Duty (PSED) requires Public Bodies to have due regard for the need to (for patients/staff/population): 1. Eliminate discrimination, harassment, victimisation and any other conduct prohibited by the Equality Act 2010 2. Advance equality of opportunity between people who share a protected characteristic and people who do not 3. Foster good relations between people who share a protected characteristic and people who do not

6 Duties Cont/ Meeting statutory Human Rights requirements - The Human Rights Act 1998 sets out a range of rights which have implications for the way MK CCG buys services and manages our workforce. In practice this means that we must:  Act compatibly with the rights contained in the Human Rights Act in everything we do Recognise that anyone who is a ‘victim’ under the Human Rights Act can bring a claim against MK CCG (in a UK court, tribunal, hearing or complaints procedure) Wherever possible interpret and apply all existing laws that MK CCG is required to take account of in a way that complies with the rights within the Human Rights Act 1998

7 The EDS2 tool kit helps the CCG to consider whether we are commissioning services which are fair and accessible to all of our population including those with protected characteristics

8 MK CCG has adopted the EDS2 system as its performance tool kit – actions so far
In 2016 evidence gathered and internally graded for 15/16 15/16 evidence was then externally verified by a small group of members of the public Equality strategy developed and four year goal setting 2016/17 evidence gathered (robust) but time constraints prevented any EDS2 re-grading

10 17/18 EDS2 -Grading Submission Evidence
Evidence was requested from: CCG Commissioners Corporate services Quality & Safeguarding Teams Safeguarding Contracting Primary Care Teams Pharmacy Team Public Health

11 All the evidence received has been gathered into the MK CCG’s 17/18 EDS2 Evidence template
The task is to review the evidence and ask the question for each of the 18 Outcomes: “how do people with protected characteristics fair compared to the rest of the population?” AND “Which of the 9 Protected characteristic groups fair well ?”

12 Things to consider? Impossible to consider every pathway/service etc… and so evidence will sometimes be examples of an approach (e.g HISU/Lakes estate) Some services are not commissioned locally (e.g gender identity clinics) National directives will dictate local priorities/system changes eg: NHS Outcomes framework STP National CQUIN programme

13 What happens now? Consider EDS2 Goal evidence per table
Agree per table each outcome grade and also which protected characteristics faired well note this down on the Goal outcome record sheet Share with the wider Group Final draft score to be agreed

14 What happens next? CCG to share internal EDS2 grading and seek public/stakeholder feedback to agree/challenge grades Agree final grade which will be ratified as part of the CCG’s Equality Annual Report NHSE’s EDS2 submission will be completed and uploaded on CCG’s Equality Webpage Web link is attached to NHSE’s EDS2 Platform Equality Strategy reviewed in the light of findings
