Stable and effective establishment

Obligation for MS to reply control demands by other MS
Possible inclusion in ERRU system
New criteria ? Link needed between country of establishment and payment of taxes/activity in that country

4. Scope extension? Today : 3,5 tonnes
Some countries apply lower limit (F, B)
But applicable on nationals only, not operators from other EU-countries
Distorted competition
Vans & subsidiarity principle?
Proposal of extension very likely
Support by UETR
Other limits for financial requirements possible

5. How to operate in another EU country
No limitations on border crossing operations within EU by operator from EU (but social?)
Cabotage limited to 3 operations within 7 days
Fierce debate, UETR :”No further liberalisation, no fundamental restriction”
But enforcement is failure and not uniform
Maximum number of operations to be cancelled
UETR : Last cabotage operation within 3 days after uncharging international load.

Formal EC-proposal before summer starts codecision procedure
EU Parliament (+ TRAN committee)
EU Council
2nd lecture by EP & Council
Conciliation procedure if needed
Procedure expected to last 2-3 years at least
Active interventions by UETR: defence of interests of SME haulers
Technical or political result?
