Subdivision Authority
The Municipal Planning Commission (MPC) is established by Council by bylaw to exercise subdivision powers and duties on behalf of the Municipality.

What is a Subdivision? New parcel of land created by way of Plan of Survey or Descriptive Plan. There are several types of subdivisions: Basic: - first parcel off of a ¼ section - 80 ac split - farmstead separation - lot line adjustment - multiple lot subdivision (2 cr & 2 ag)

Multi Lot Subdivision: - consists of residential parcels, internal roads, storm water management system, utilities, environmental reserves and municipal reserves. - an Area Structure Plan (ASP) and Land Use redistricting bylaw may be required prior to a subdivision application Multiple Lot Subdivisions and Multi-Lot Subdivision require a Plan of Survey. 1st parcels out & 80 acre splits can be done by Descriptive Plan

Steps of Basic Subdivision Farmstead Separation
Meet with applicant to discuss proposal and review application Determine location of above ground sewer pump out to ensure the setbacks to the new property lines meet provincial regulations Determine zoning and soil assessment Once application is complete and fee paid, application is processed. Referral letters sent to government agencies (such as Alberta Transportation, Alberta Environment), Infrastructure Services & AG Services, utility companies, any one with an interest on title, adjacent land owners. Do site inspection and create report for MPC with the recommendation to approve with conditions. Once decision is made, advise applicant and referral agencies of approval Prepare development agreement & have it signed by applicant, MPC Chair and County Manager. Prepare Caveat and register copy of development agreement on title. This Caveat will stay on title until County widens the road.

Conditions of Farmsite Subdivision
Basic Conditions: Development Agreement entered into Approaches to farmsite and remnant parcel All current and outstanding taxes are paid Additional Conditions: Above ground sewer pump out identified by surveyor or have system inspected by inspector to ensure it complies with Provincial Regulations 17’ future road widening requirement Other Additional Conditions that may be included: Prior to development locate and mark abandoned wellbore including 10m surrounding the wellbore and 8m access to public road Road side Development Agreement with Alberta Transportation if along highway and they ask for 30m service road dedication Cash in lieu of Municipal Reserves (or Deferred Reserve Caveat) Environmental Reserve Easement

Approval timeline Application received and once deemed complete (within 20 days) MPC has 60 days to give a decision. Applicant signs an extension agreement if the MPC meeting date is past the legislated 60 days From date of decision applicant has one year to complete the conditions and have the plan registered at Land Titles Extension can be requested by the applicant if not ready to register within one year. Subsequent extensions can be requested along with extension fee (1st extension is free, 2nd extension if $100, 3rd is $150 and 4th & beyond is $200).

Application for MDP/LUB redistricting Create bylaw(s) and report for MPC to recommend that Council give 1st reading Council to give 1st reading and schedule public hearing date and advertise Council to give 2nd & 3rd reading to bylaw(s) Update bylaws & mapping
