FCC issues Notice of Proposed Rulemaking, Unlicensed Operation in the TV Broadcast Bands (ET Docket No and ET Docket No ), released May 25, 2004
The Commission seeks comment on a range of issues related to the operation of unlicensed radio transmitters in the TV broadcast spectrum at locations where that spectrum is not being used
TIA filed comments in this proceeding on November 30, 2004
FCC activity on this proceeding stalls……..

3. Congressional Activities
Title VI of the Communications, Consumer’s Choice, and Broadband Deployment Act of 2006 contains the ‘‘Wireless Innovation Act of 2006’’ (‘‘WIN Act of 2006’’) introduced in the Senate Commerce Committee.
Allows a certified unlicensed device to use eligible broadcast television frequencies in a manner that protects licensees from harmful interference.
Outcome of this legislation is still unknown…..
