TRIPARTITE (COMESA, EAC AND SADC)
TRANSPORT AND TRANSIT FACILITATION PROGRAM The overall strategic objective is to facilitate the development of a more competitive, integrated and liberalised regional road transport market in the Tripartite region. The project purpose is to develop and implement harmonised road transport policies, laws, regulations, procedures and standards for efficient cross border road transport and transit networks, transport and logistics services, systems and procedures in the Tripartite region. The expected Key Results are: Result 1: Tripartite Vehicle Load Management Strategy Implemented. Result 2: Pre-conditions for an operational East and Southern transport registers and information platform and systems implemented. Result 3: Harmonised Tripartite vehicle regulations and standards implemented Result 4: Efficiency of regional transport corridors improved

TTTFP IS BASED ON VALIDATED BASELINE SURVEYS OF 2016
The Baseline Survey assessed the extent of compliance with the baseline requirements (necessary for TTTFP implementation) by each of the 19 Tripartite member countries (listed in alphabetical order): Angola Botswana Burundi DRC Djibouti Eritrea Ethiopia Kenya Lesotho Malawi Mozambique Namibia Rwanda South Africa Swaziland Tanzania (Zanzibar) Uganda Zambia Zimbabwe NB South Sudan & Sudan still to be done The baseline Survey established the gaps between the current status in each country relative to the Tripartite harmonisation requirements. The gap informed the design of the TTTFP. Therefore TTTFP will help each MS to close the gap. TA to be provided must be related to these gaps.

TTTFP IS BASED ON VALIDATED BASELINE SURVEY – COUNTRY REPORTS
Each country’s separate report contains detailed recording of the current status and highlights deviations [GAPS] from the Tripartite baseline requirements in respect of the following issues relating to vehicles, drivers, professional drivers, responsible competent persons and operators: These reports are already uploaded on COMESA, SADC, EAC and TTTFP portals Enabling legislation Standards Training Testing Facilities Computerised registers and systems Vehicle load management 3rd Party Insurance Voluntary compliance Law enforcement Exchange of information

PROJECT FUNDAMENTALS Entire programme hinges on harmonisation & liberalisation of road transport Signature of multilateral agreements Vehicle Load Management Agreement (VLMA) Multilateral Cross Border Road Transport Agreement (MCBRTA) Baseline Requirements derived from Agreements to enable member countries to comply with provisions of and implement the Agreements Vehicle Dimensions & Equipment on Vehicles Vehicle Load Control, Abnormal Loads & Dangerous Goods Vehicle Fitness Testing Driver Training & Testing Operator responsibility for quality of operations Decriminalisation of offences & demerit point system Compliant systems for effective & efficient administration

ENABLING ENVIROMENT Enabling legal instruments
Implementation of provisions of VLMA & MCBRTA require adoption of enabling legislation Model Laws covering spectrum of baseline harmonisation envisaged in VLMA & MCBRTA Framework for compliant systems & exchange of information amongst member states by TRIPS TA to countries to assist in domestication of Model Laws or amendment of current laws

MODEL LAWS BEING DEVELOPED
Vehicle Load Management Model Law Vehicle and Driver Quality Model Law Cross Border Road Transport Model Law (including Liberalisation & Operator Responsibilities) Dangerous Goods Model Law Model Law on Decriminalization of Road Traffic & Transport Offences, and Demerit Points Framework & principles were reviewed at Tripartite-Wide workshop on 23 to 25 April 2018 in Nairobi, Kenya. COMESA, EAC and SADC legal counsels were invited to attend

IMPLEMENTATION APPROACH
Implementation takes place in 4 stages Stage 1: Establish Statutory Basis Stage 2: Institutional Capacity and Development of Systems (e.g Operator, TRIPS, Interfaces) Stage 3: Project Implementation of Systems Stage 4: Execution in selected corridors, Monitoring, Evaluation and Roll-out Strategy
