1 …determine if the disability adversely affects the educational performance of the child to the extent the child needs specially designed instruction and related services “Adverse effect” means that the progress of the child is impeded by the disability to the extent that the educational performance is significantly and consistently below the level of similar age peers. “Specially designed instruction” means adapting, as appropriate the content, methodology, or delivery of instruction to address the unique needs of the child with a disability and to ensure access of the child to the general curriculum included in the Program of Studies. The disability must adversely affect to the degree that Specially designed instruction is needed.
