National Defense Authorization Act (NDAA) FY1999 - Reimburse Federal Govt Agencies required to relocate or modify radio systems to accommodate private sector use of spectrum FY2000 (Surrender of spectrum in which DoD is a primary user) NTIA, in consultation with FCC, must identify & make available to DoD for its primary use, if necessary, an alternate band as a replacement for DoD spectrum surrendered Secys of Commerce & Defense and Chm of Joint Chiefs must jointly certify to certain Congressional committees that alternate bands provide comparable technical characteristics to restore essential military capability

11. Conclusions 1. Sharing with 3G will be difficult 2. Spectrum for relocation of all Govt Systems is not available 3. Of the options considered, two (out-of-band pairing) have possibilities to accommodate 3G assuming NDAA conditions are met and continuity of govt operations is maintained 4. Vacating portions of 1710-1850 MHz band could vary from 9 to 29 years assuming comparable spectrum is available 5. FCC/NTIA Final Reports are inputs to the on-going spectrum rule-making process
