Read the Introduction.. Understand the story (facts) Understand the stipulations – What are these? What elements must Pat prove in order to prevail (win)

Homework: Due Thursday (25 Points)
Read the next 2 sections “complaint” and “answer to complaint.” Answer the following questions: Who is the plaintiff and defendant in this case? What is the jurisdiction of this case? Why? Summarize Pat Johnson’s complaint (what has been done wrong to him?) What dose Pat Johnson want (prayer for relief?) An affirmative defense is justification for an act that might otherwise be wrong (like killing someone in self defense.) What affirmative defenses does the school offer? In addition, please come to class with one additional question you have about the case or the mock trial process.

Activity: Understanding the Pretrial Steps
Pick up the next section of your trial packet “The Litigation Process.” This section describes what happens at trial and how to do it. You should begin reading this packet! In a group (partner or alone) focus on “Initiating A Civil Lawsuit: Pretrial Steps” Get a Piece of paper and divide it into 4 squares. Label each square A-D. In each square state the pretrial step and then write a short description of what happens during each step. Hand this in Today!

For Friday! Read over the next section “II. Trial” (pp 32-46)
Pay special attention to 15 steps during trial Tomorrow we will go over what happens at each step of a trial
