2 Define criminal law and civil law. Give an example.
Criminal Law - laws that define what acts are; stealing, rape, assault Civil Law - laws that refer to disputes between people. No crime has been committed; contract disputes, divorce, property disputes

3 Define the 4 sources of law (Statutory, common, administrative, and constitutional) and give an example of each Statutory Law – laws made by Congress/state & local gov’ts; right vs. wrong laws. Example: public buildings must have a certain number of exits Common Law - type of law that comes from judges’ decisions that are common sense and previous cases Example: Running an automobile into a horse

4 Administrative Law - laws created by gov’t agencies
Define the 4 sources of law (Statutory, common, administrative, and constitutional) and give an example of each Administrative Law - laws created by gov’t agencies Example: The Consumer Product Safety Commission (CPSC) says a toy is unsafe. Constitutional Law - based on the Constitution & on Supreme Court decisions. Example: You have the right to sue if someone takes away one of your Constitutional rights.

5 What is the difference between original and appellate jurisdiction?
Original Jurisdiction: have authority to hear a case for the first time Appellate Jurisdiction: have the authority to review a case in order to decide if law was applied fairly

6 Who appoints federal judges? Who approves these appointments?
President appoint federal judges and the senate approves the appointments

7 What are qualifications to become a Federal judge?
NO QUALIFICATION

8 What is the district court? What makes them unique from other courts?
Have original jurisdiction for federal cases Have judges and juries and reach verdicts

9 What are three possible outcomes in a Court of Appeals decision
What are three possible outcomes in a Court of Appeals decision? What is an appeal? 3 judge panel (not a jury) makes decision to: Affirm - agree with the trial court's decision Reverse the decision of the trial court Remand - send back to lower court Appeal - process by which the person asks a higher court o review the results of the trail

What is the Supreme Court? When do they have original jurisdiction? What is Judicial Review? Highest court in the land 1 chief justice + 8 associate = 9 justices Original Jurisdiction only in 3 situations: 1. Cases involving diplomats of other countries 2. Cases between states 3. Cases between states & the federal government

11 What is the difference between a concurring and dissenting opinion?
Dissenting opinion – explains why they believe the majority are wrong Concurring decision - agree, but for different reason

12 Brown V. Board of Education, Plessy V. Ferguson, and Miranda v
Brown V. Board of Education, Plessy V. Ferguson, and Miranda v. Arizona --- What are the outcomes? Brown v. Board of Education -Segregated schools are NOT equal, hence they are unconstitutional Plessy v. Ferguson - Segregation is okay as long as it is equal --- separate but equal Miranda V. Arizona - You must be read your rights before you are interrogated
