Mexican border band plan remains unresolved Negotiations extended until April 1, 2009 Freeze extended until May 13, 2009 FCC began accepting applications for first 20 Nextel Vacated Spectrum on January 28, 2009

2 800 MHz Rebanding 800 MHz Plan Modification for Regions in Non-Border Areas (Waves 1-3) FCC established 2 plan amendment procedures 1) Amendments that are Rebanding Related Only (Shifting frequencies down 15 MHz) No adjacent Region concurrence required Amendments must be filed by April 13, 2009 Expedited FCC review - will not be put on Public Notice 2) Additional amendments to the Plan (Changing frequency allocations/allotments, technical parameters, application filing procedures) Adjacent Region concurrence IS required Must notify FCC by April 13; File amendment by June 10 Normal FCC review process Amendments must include a cover letter signed by the RPC chair and referencing the original docket #

3 DTV Transition Extended
On February 4th, Congress passed a bill to extend the DTV transition deadline from February 17 to June 12 Not yet signed by President (as of 2/9/2009) Many stations have already moved For 66 TV/DTV transmitters in continental US affecting PS spectrum, as of 2/6/2009 6 stations are already ‘silent’ At least 1 other station is operating at reduced ERP 6 more stations filed applications to go ‘silent’ on 2/17/2009 These stations must confirm status by midnight on 2/9/2009 PS must protect co- and adjacent channel full-power TV & DTV stations that continue to operate after Feb 17th until June 12th, or earlier termination

4 700 MHz 13 Plans are Approved Three 700 MHz Regional Plans approved since November Region 1 (Alabama) Region 7 (Colorado) Region 51 (Texas-Houston) 17 Plans Pending; Six filed since November Region 54 (Chicago area) Region 33 (Ohio) Region 6 (Northern California) Region 10 (Georgia) Region 13 (Illinois) Region 28 (E.PA/S.NJ)
