PRESENTATION TO PORT FOLIO COMMITTEE : 27 MARCH 2008 : DCS ON CHILD JUSTICE BILL Introduction to Central Services Branch Building a caring correctional system that truly belongs to all Presented by: DC Remand Detention Systems and Security Date: 27 March 2008 1

2 1. BACKGROUND During 2006 Cabinet has mandated DCS to lead a JCPS Project Team. Focus Area 1 : develop a program for better operational management of RD’s. determine causes of backlogs and provide recommendations to handle backlogs within the Criminal Justice System for Awaiting Trial Detainees. Focus Area 2 : determine a strategic level approach that can be followed by the Government to manage service delivery to Remand Detainees. develop proposals in relation to the establishment of an Institutional Framework for Remand Detention Management. determine long term proposals in relation to a mandate and institutional arrangements for the management of remand detainees.

KEY DELIVERABLES 2.1 Policy, Procedures, protocols and legislative framework revisit current DCS policy guidelines impact analysis audit analysis of existing legislative framework develop procedures and protocols 2.2 Research interdepartmental situational analysis/rapid appraisal collect and analyse international best practice

Establish baseline information effective from April 2008 Negotiate development of common information management systems Investigate potential use of electronic monitoring Alignment of admission and release systems Monitoring and evaluation tools 2.4 Human Resource Strategy Profile personnel services, competency and provisioning model Structure and management capacity Develop and deliver training programmes

5 2.5 Development of Remand Detention Infrastructure
Conversion of the 10 facilities Review the existing minimum facilities requirement Video postponement Audit of existing facilities Feasibility study on one-stop service facilities Ongoing infrastructure upgrading and maintenance 2.6 Financial requirements Develop an appropriate costing and budgeting model Develop cluster budgeting proposals

The following 10 DCS Facilities have been earmarked as RDF’s Pollsmoor Admission Centre, Pietermaritzburg CC, Potchefstroom CC, Pretoria Local, Johannesburg Med A, St Albans, Durban Westville Med A, Boksburg CC, Modderbee CC and Grootvlei Maximum

16 4. CHALLENGES Training of personnel to deal with children issues and complexity of the development of a child. Provision of age appropriate facilities and services to children – not to alienate the child. Inadequate collaboration with other Departments for provision of services to Children Awaiting Trial.

17 CHALLENGES CONTINUED Accommodation of children designated to Reformed Schools and Schools of Industries Children still being sent to DCS facilities as awaiting trial due to alleged security threats at Secure Care Facilities Possible postponement by the Court on cases of children and court decisions to be adhered to. Minimal utilization of Restorative Justice approach to ensure mediation and reparation rather than incarceration of particularly for minor offences.

18 IMPLICATIONS OF THE CHILD JUSTICE BILL
Section 30 stipulates: children of 12 years might be detained in prison. This necessitates for: Trained personnel in handling children issues especially frontline personnel Appropriate facilities (child friendly) More facilities are required to separate children according to specific age categories Specialists with knowledge on children issues to be recruited

DCS to avail the child for inquiry when ordered to do so Intensify implementation of 276(1)(i) for children (assessment and compilation of reports)
