46 PURPOSE OF BLUE BOX PROGRAM PLAN To provide financial stability to Ontario's municipally operated Blue Box programs: to expand the recovery of designated Blue Box wastes to improve the efficiency of municipally run programs to create new uses for and products made from recovered Blue Box wastes 46

47 PROGRAM PLAN FEATURES Industry and Municipalities each to pay 50% share of municipal Blue Box Program net costs Include a funded research & development program to improve Blue Box program effectiveness & efficiency Include a funded program for market development Include a funded program for education and public awareness Pay-Out funding formula recognizes regional variations, and provides incentives to encourage municipal program effectiveness & efficiency 47

48 PROGRAM RULES In order to be in conformance with provisions of the Waste Diversion Act, Stewards of designated Blue Box Waste are now required to: Join Stewardship Ontario (approved IFO) File an annual report on Blue Box Waste generation Pay fees associated with the submitted Report 48

49 BLUE BOX WASTE REGULATION Ontario Regulation 273/02: Waste that consists of any of the following materials, or any combination of them, is prescribed as Blue Box waste for the purposes of the Act: Glass Metal Paper Plastic Textiles 49

50 WHAT THE PROGRAM PLAN COVERS Packaging and printed materials that: Are consumed in the household, and Managed through municipal waste management systems 50

51 BLUE BOX WASTE INCLUDES But not limited to (examples only): Printed materials Newspapers, flyers, magazines, catalogues, directories, direct mailings, bills, unsolicited mail, product inserts, instruction guides etc. Packaging Product and service packaging made of paper, plastic, aluminum, steel, glass and combinations of these materials 51

52 BLUE BOX WASTE DOES NOT INCLUDE Transportation packaging – where the final consumers are non-residential establishments Industrial or bulk packaging – that is not intended for sale or use by consumers in the home Durable packaging – such as storage boxes with a useful life of at least five years and which remain with product throughout useful life 52

53 Other items that are not generally considered packaging: Do not serve packaging function (e.g. napkins) Empty products (e.g. garbage bags) Integral part of the product (e.g. toner cartridge) Packaging materials that are not covered under Blue Box Regulation: Wood, ceramics, crystal, rubber, leather BLUE BOX WASTE DOES NOT INCLUDE 53

54 WHO IS A STEWARD? Brand owner of products, the packaging and printed materials of which is defined as Blue Box Waste In a franchise system, the franchisor is designated a steward First importer into Ontario of specific products, the packaging and printed material of which is defined as Blue Box waste, for which a brand owner does not exist Any person who elects to become a steward for designated Blue Box waste that would otherwise be the responsibility of another steward 54

55 ELECTED STEWARDS A declaration to be completed by Electing Steward and sent to Stewardship Ontario Intent is to have electing Steward assume obligations for those products for which it is the brand owner/ trademark holder for Blue Box waste sold or distributed in Ontario Electing Steward will notify customers, file report and pay fees – like any other Steward Declaration form in final draft stage and will be posted on the Stewardship Ontario website We welcome your comments 55

56 WHO IS EXEMPT? Program includes de minimis exemptions as required by Minister Balance between level playing field and limiting impact on small business Two levels of exemption: Level 1 – 2002 sales in Ontario of less than $2 million Level 2 – sales above $2 million, but less than 15 tonnes of Blue Box Waste in 2002 56

57 2004 STEWARD REPORTS Reports to be based on calendar 2002 packaging and printed paper generation data Reports to be filed using on-line Data Reporting & Management System Deadline for submitting report and payment is April 20, 2004 57

58 REPORTING OPTIONS Options for submitting data: 1)Report actual/measured Blue Box Waste sold/distributed in Ontario in 2002 2)Report Canada wide data and apply proportion of sales to Ontario 3)Report using Stewardship Ontarios Sectoral Calculator on Ontario sales 58

59 REPORTING ACTUAL DATA Report according to 19 Designated Blue Box Waste categories – review and become familiar Report kilograms sold or distributed in Ontario in 2002 You will be required to describe methodology used to calculate these quantities Describe and present estimates of any Material Data deductions made for non- obligated materials 59

60 WHERE MATERIAL DATA RESIDES Material data for reports is typically available from a number of sources: suppliers packaging specs bill of materials packaging design staff third party databases consultants – plus website showcase Plan for the longer term 60

61 SECTORAL CALCULATOR CONDITIONS/LIMITS Approved for Year 1 reporting only Represents reasonable estimate by sector Use of the tool is voluntary Fee calculation results cannot be revised or resubmitted later Cannot be used to quantify printed paper or service packaging 61

62 PROCESS FOR 2004 Details not yet finalized; subject to decisions of Stewardship Ontario Board of Directors At this time, Stewards expected to report Blue Box data once – deadline is April 20, 2004 based on 2002 data Report will be used as basis for two payment calculations: 1)Pro-rated for 5 months (Feb – June) at the rates posted in the Plan 2)Pro-rated for 6 months (July – Dec) at the new rates to be approved by Minister 62

63 PAYMENT SCHEDULE Currently planning schedule – two invoices in calendar 2004: First invoice is generated from on-line system and payment is due April 20 th for first five months Second invoice will cover obligations for last six months 63
