2 Discussion and Review What were some of the results of the intense division in Kansas? What did Stephen Douglas and the railroad have to do with the Kansas-Nebraska Act? Where did the Republican party come from?

3 Dredd Scott Decision BG: Dredd Scott was a slave of Dr. John Emerson
They traveled to the free states of Illinois and Wisconsin for Dr. Emerson’s work. They went back to Missouri (a slave state) and the dr. died. Dredd Scott sues for his freedom: He spent time in a free state where slavery is not allowed so that made him a free citizen. Decision: Chief Justice Robert B. Taney African Americans, whether free or slave, were not considered citizens of the United States. Constitution does not give them rights. “Founding Fathers did not intend to give them rights.” Dred Scott couldn’t sue in federal court because he is not a citizen. Dred Scott’s residence in the North doesn’t matter because he went back to Missouri, so he has to go by Missouri’s laws. The Missouri Compromise is unconstitutional. Congress didn’t have the right to ban slavery. Constitution guarantees : “life, liberty, and property”. Slaves are property. You should be able to take your property anywhere without it being taken away.
