Warm Up – March 12 Answer the following questions on a post it:
What is the job of the Legislative Branch? How many years are in a Senator’s term? How many for the House of the Representatives? Who votes for Senators? Who votes for members of the House of Representatives? Who does a Senator represent? Who does a member of the House of Representatives represent? What is the term to describe the powers specifically given to the national government?

Powers of Congress

Expressed Powers Expressed powers - powers specifically given to Congress in Article I, Section 8 of the Constitution. First 17 clauses of the Constitution are expressed powers Examples-Congress can borrow money, declare war, raise an army (these powers are actually written in the Constitution.)

Implied Powers Implied Powers- powers not specifically written in the Constitution. Article I, Section 8, Clause 18 and is known as the NECESSARY AND PROPER CLAUSE or ELASTIC CLAUSE Examples- airline regulation, drug trafficking (these items aren’t mentioned in the original document.

Legislative Powers Any power given to Congress that deals with making laws Examples: laws that deal with spending money, regulating trade, foreign relations.

Non – Legislative Powers
Any power that does not deal with making laws. Examples-removal of government officials, investigations, making an amendment

Powers Denied to Congress
Article I, Section 9- There are certain things Congress cannot do Cannot suspend Writ of Habeus Corpus (cannot detain an individual without cause) No Bill of Attainder – cannot determine the guilt of an individual Cannot pass Ex Post Facto Laws - laws that declare an act illegal after it has been committed Can’t place export taxes on goods Post-Preference Clause – Can’t pass laws favoring one state over another
