Teachers may use these materials, but they must be acquired legally.
Use should be instructional, not for entertainment

4. Questions When Using Youtube.com
Does it violate the four “Fair Use” principles?
Did you download the video onto your computer?
Are you showing a full length movie?
Does it have Creative-Commons License?

5. With your group, discuss whether the following scenario violated copyright. Scenario #1:
Mr. Yan wanted to incorporate clips of Iron-Jawed Angels (2004) on Youtube.com into his US History unit on women’s suffrage. The teacher showed five short clips each lasting about a minute each to his class and held a class discussion after each clip. After the clips were finished, the students completed a reflective writing assignment on the lesson.
Did the teacher violate copyright laws? Why or Why not?

6. Scenario #1: Solution
The teacher would not have violated copyright laws due to the “Fair Use” clause of the Copyright Act.
The teacher showed brief clips which was a fraction of the entire movie.
The movie clips were used for instructional purposes.
The clips would not have hurt the Market value of the movie, as the movie was issued almost 13 years ago.

7. With your group, discuss whether the following scenario violated copyright. Scenario #2
Mrs. Young owns the movie The Boy in the Striped Pajamas (2008). She has finished a unit on the Holocaust and wants to show a movie and have the students write a paper on the Holocaust.
If Mrs. Young shows the entire movie in class, will she violate copyright?

8. Scenario #2: Solution
Mrs. Young is well within her right to show the movie to her class. It is educational, related to her lesson plans, and she owns the movie.

Students may use up to 10% or 3 minutes of copyrighted works (whichever is less).
Material must be acquired legally, and proper citation must be given to copyright holder

10. With your group, discuss whether the following scenario violated copyright. Scenario #3:
Mrs. White had the students re- create a movie over the Civil Rights Movement. The students used 7 minutes from the movie Selma (2014). Selma’s runtime is 2 hours and 8 minutes.
Did the students violate copyright?

11. Scenario #3: Solution
While the project was creative and the students had good intentions. They used too much of the movie in their projects, therefore violating copyright.
Selma is 128 minutes long, and by copyright standards, the students should only have been allowed to use up to 3 minutes in their projects.
