THE RIGHTS OF CHILDREN WHEN QUESTIONED OR ARRESTED
What’s the same? Right to silence Time limit on questioning (though it’s only 4 hours, not including “time out” periods to eat and call and lawyer, etc) Still have to answer questions about car accidents, give your name and address, etc What’s different? Right to have an “independent adult” (usually a parent/guardian/”support person”) present during questioning (unless there’s a “proper and sufficient reason” for one not to be there) Confessions can’t be admitted into evidence unless the kid has a support person/lawyer/other adult there Legal Aid will be provided (through the ‘Duty Solicitor Scheme’) without charge and without means testing

Can you make connections between the statements in the CROC to the way minors are treated in the criminal system as stated in the above notes?
