Causing death while operating a motor vehicle Negligent and under the influence of any amount, even under .08 Alcohol level over .08, even if not negligent

For causing death or death of an unborn child the penalty is up to 10 years/$20,000 For “great bodily injury” the penalty is up to 5 years/$10,000
