Section II: Business Practices
Be PROACTIVE!!!! What are companies currently doing to deal with sexual harassment? Establishing a Sexual Harassment Policy Make sure the company has a sexual harassment policy If they don’t, then make one that is CLEAR and CONCISE Ensure sexual harassment will not be tolerate in the workplace Make sure all employees know about the policy
2
Make sure all employees are trained to identify inappropriate workplace behavior
Ex. Inteliquent is currently putting together a formal sexual harassment training program for all employees and upper level management to go through The company should come up with some sort mechanism or way for employees to report sexual harassment Employees are then encouraged to stand up for themselves immediately EEOC recommends that companies designate more than one person to take complaints about sexual harassment Reduces likelihood of biases
3
Upper-level management must prepare to take immediate disciplinary action against employees that commit a sexual harassment act This includes… Investigation/hearing both sides of the incident Further investigation may be needed Then determining the severity Progressive disciplinary action Immediate termination If a company does not take care of a sexual harassment case immediately then they run the risk of being sued Costs of training and setting up a policy are much less than… back pay, lost wages/ benefits, reinstatement or front pay, plaintiff’s attorney’s fees, payment of plaintiff’s expert witness fees, compensatory damages for emotional pain and suffering, punitive damages, and lastly court costs if a company were to lose a sexual harassment case in court
