Destatis/ IT.NRW plan to commission a comparative law report for Germany Eurostat has assigned a contract to analyse the legal situation in Europe Legal benchmarks are France and the United Kingdom Recommendations by the UN Global Working Group on Big Data Communication guidelines of the European Commission

Possible solutions in Germany
Data should be free of costs Benchmark: national legislation for administrative data (BStatG, section 5a) Transmission of metadata and test data on request For implementation, a specific legal regulation is needed Maybe pre-processing of data by the private enterprises Reimbursement of the private enterprises?

Additional (legal) questions
Is there a difference between „big“ and „regular“ data? Is there a specific data protection needed to avoid unfair competition? Who owns the data? Does big data affect the professional standards of official statistics? How do we regulate the combination of big data with survey and administrative data? How do we guarantee the data availability for science? How do we ensure the transparency of the data processing?
