1 Title IX and Study Abroad
The Catholic University of America By Frank Vinik, JD Title IX Coordinator

2 Thank You for Attending!
Want presentation to be interactive Feel free to ask questions at any time Feel free to call afterwards if want to discuss sensitive situations

3 What Should You Do? During your study abroad trip, a student named Emma comes to you and says she was sexually assaulted. Should you listen to Emma’s story? Are you legally obligated to tell Emma anything before listening to her story? Can you promise her confidentiality?

4 Background Title IX prohibits sexual harassment or assault at colleges that receive federal funds Title IX applies whenever a CUA employee or student is involved regardless of location Under CUA policy, employees who accompany students on a trip are “responsible employees” Responsible employees must report allegations of sexual assault that they know or hear and cannot promise confidentialiy

5 Responding to Emma Before you tell me anything, I need to reveal that I am a responsible employee and have to report what you tell me to CUA If you want complete confidentiality, we can arrange for you to talk or Skype with: Professional mental health counselors Someone licensed to practice medicine Clergy when made in their professional capacity If you talk to me, the information will be kept private on a need to know basis

6 If Emma Talks to You Be careful not to judge credibility
Just gather the facts Reassure about lesser violations such as drinking or consensual sex

7 After you hear what she has to say
Encourage her to go to hospital if she was recently raped Do research – Are there hospitals nearby with nurses trained to deal with rape victims? Report to DPS at CUA - extension 5111 “Move the box” to professionals trained to deal with this No retaliation Arrange for support through Dean of Students office even if she does not tell you anything

8 When in Doubt, Report! Do not freelance or handle alone
Use CUA resources
