2 Purpose of this presentation
This presentation will provide a broad overview of the functions and statutory obligations of the Development Department and how these functions relate to private residential facilities.

3 Purpose of the Development Management Department
The Development Management Department directs and manages land use and building development in Cape Town to benefit residents and visitors and conserve the city's natural and built heritage in an organized and optimal approach in accordance with statutory requirements. This include the regulation of private residential facilitiy land uses and the impact of it on the surrounding environment and vice versa.

What is Land use management? Land use management is to ensure that all land and properties are used in accordance with their permitted land-use or zoning rights allocated to the specific property. The City of Cape Town Municipal Planning By-law, 2015 is a primary tools in Land use management. The department facilitates applications to change permitted land uses, zoning rights and their accompanying restrictions.

What is Zoning and what is the purpose of zoning? Zoning means a category of directions setting out the purpose for which land may be used and the land use restrictions applicable in respect of the said category of directions. The purpose is very clear: to control land uses in an orderly fashion, and it therefore determines city form and function.

What is a Development Management Scheme? A development management scheme (part of the municipal planning by-law) is the primary tool to control zoning and consists of the following: Definitions; Regulations / parameters / restrictions; Zoning maps. Levels of rights in a zoning include primary use rights, additional use rights, consent uses and departures.

Development management scheme applicable in Cape Town The Development Management Scheme is applicable in the City. Amongst other things, the scheme make provision for private residential facilities in the definition of ‘institution’: ‘institution’ means a property used as a welfare facility such as a home for the aged, retired, indigent or handicapped; or a social facility such as a counselling centre, orphanages or reformatory; and includes ancillary administrative, health care and support services for these facilities; but does not include a hospital, clinic or prison;

8 Development Management service delivery model
Functions are delivered through a network of 8 decentralised district offices. Services offered include: Pre-application advice to the public; Processing and facilitating applications; Enforcement; Issuing of zoning certificates; Investigating and resolving complaints.

9 General land use development application procedure
Pre-application advice and consultation; Submission; Public Participation; Detailed Technical Assessment; Decision; Notification of decision; Appeal, if any.
