Degrees of Murder First Degree: Intentionally decides to kill. There is malice (evil desire to kill) with premeditation (thought about beforehand) and deliberation (weighing the consequences). PENALTY: life imprisonment or death

Degrees of Murder Second Degree: Killing someone intentionally and with malice; however, it was not deliberate or premeditated. PENALTY: Up to life imprisonment

Degrees of Murder Voluntary Manslaughter: Killing someone in the heat of passion and in response to adequate provocation by the victim PENALTY: up to 15 years imprisonment

Degrees of Murder Involuntary Manslaughter: Unintentionally killing someone without malice, but with recklessness and involvement of extreme danger of death or serious bodily harm. PENALTY: up to 5 years imprisonment
