Early disclosure to the Working Group of patent information that might be relevant to the standard is essential to reduce the possibility for delays in the development process and increase the likelihood that the draft publication will be approved for publication. Please notify the Chair as early as possible, in written or electronic form, if patented technology (or technology under patent application) might be incorporated into a draft standard being developed within the IEEE Working Group. 4 6. Patents IEEE standards may include the known use of essential patents and patent applications provided the IEEE receives assurance from the patent holder or applicant with respect to patents whose infringement is, or in the case of patent applications, potential future infringement the applicant asserts will be, unavoidable in a compliant implementation of either mandatory or optional portions of the standard [essential patents]. This assurance shall be provided without coercion. The patent holder or applicant should provide this assurance as soon as reasonably feasible in the standards development process. This assurance shall be provided no later than the approval of the standard (or reaffirmation when a patent or patent application becomes known after initial approval of the standard). This assurance shall be either: a) A general disclaimer to the effect that the patentee will not enforce any of its present or future patent(s) whose use would be required to implement either mandatory or optional portions of the proposed IEEE standard against any person or entity complying with the standard; or b) A statement that a license for such implementation will be made available without compensation or under reasonable rates, with reasonable terms and conditions that are demonstrably free of any unfair discrimination. This assurance is irrevocable once submitted and accepted and shall apply, at a minimum, from the date of the standard's approval to the date of the standard's withdrawal and is irrevocable during that period.

5 Inappropriate Topics for IEEE WG
Don’t discuss the validity/essentiality of patents/patent claims Don’t discuss the cost of specific patent use Don’t discuss licensing terms or conditions Don’t discuss product pricing, territorial restrictions, or market share Don’t discuss ongoing litigation or threatened litigation Don’t be silent if inappropriate topics are discussed… do formally object. If you have questions, contact the IEEE-SA Standards Board Patent Committee Administrator at or visit This slide set is available at

29 Motion Move to remove QoS Metrics from the next version of the TGk draft. Moved: Ganesh Seconded: Ecclesine Discussion on Motion For: 0 Against: 8 Abstain: 0

30 Motion Move to accept the resolutions for TGk LB86 comments as written in spreadsheet document 06/1489r2, assigned to Hart, and to instruct the secretary to incorporate all such resolutions therein into the next version of the comment resolutions rollup spreadsheet and instruct the editor to incorporate all such resolutions therein into the next TGk draft. Moved: Hart Seconded: Ecclesine Discussion on Motion For: 8 Against: 0 Abstain: 0

31 Motion Move to counter CID33 with resolution “the AP Service Load is renamed to AP Average Access Delay. See resolutions to CID158 and CID257,” and instruct the TGk editor to incorporate these changes into the next version of the TGk draft. Moved: Kwak Seconded: Hart Discussion on Motion For: Against: Abstain:

32 Motion Move to decline CID34 with resolution “the mathematical expression on P47L22, is used as a means to describe the required scaling for the access delay subfields. The use of logarithms in the description of the required scaling does not imply any required implementation. An alternate and equivalent description of the required scaling may be defined in a table or by a number of other descriptions. The implementer may choose to implement this scaling in many different ways. Table lookup for the scaled values is a low complexity implementation, but is not required. Any implementation of the required scaling is allowed. Also see related CID159.” Moved: Kwak Seconded: Ganesh Discussion on Motion For: Unanimous Against: Abstain:

33 Motion Move to counter CIDs 29, 30, and 257 with resolution “As the commenter notes, any interference in the BSS which would trigger physical carrier sense, would increase the measured access delay. This interference is not, strictly speaking, a load element.” P43L3: change “BSS Load” to “BSS Average Access Delay”, here and in all places. P43L4: replace the first sentence of this paragraph; “BSS Average Access Delay element contains the average AP access delay which is a measure of service load in the BSS.” P43L8; change “AP Service Load” to “AP Average Access Delay” here and in all places. Also see related comment resolution in CID 158.” Instruct the TGk editor to incorporate these changes into the next version of the TGk draft. Moved: Kwak Seconded: Hart Discussion on Motion For: Unanimous Against: Abstain:

34 Motion Move to accept the resolutions for TGk LB86 comments as written in spreadsheet document 06/1529r1, assigned to Kwak, and to instruct the secretary to incorporate all such resolutions therein into the next version of the comment resolutions rollup spreadsheet and instruct the editor to incorporate all such resolutions therein into the next TGk draft.
