Executive agreements are made between heads of states not states.

Party Practice Parties nominate candidates and the government is governed with parties in mind.

Custom The President’s cabinet is not set forth by the Constitution.
Senatorial courtesy is used to get people appointed. Presidential terms were unwritten customs until the 22nd amendment.
