Two seats on the Corporation Comm went to the highest bidder
How much did APS pay to control the Commission that sets utility rates?
$10.7 million!!!
Not an election -- it was an auction!
Raised utility rates $95M per year

What APS did then is still perfectly legal!

Citizens United let corporations contribute for the first time,
But, corporations tend to be Risk Adverse
Not want attention from:

shareholders and
Regulators
Disclosure might be the kiss of death to candidates they support
So found a legal means to hide

Az legislature has made it easier and easier to hide
What ODM initiative will do:
Right to Know the original source of all contributions seeking to influence our vote.
‘original source’ is the person or corporation that earned the money
have to disclose if spend over $20,000 statewide or $10,000 for all others
Must disclose the original source of all contributions over $5,000
Citizen Clean Election Commission writes rules and does enforcement
Provides a citizen right of action
robust Penalties up to 3X the amount undisclosed
Need 357,000 signatures by July 2020

7. No Right to Hide in our Constitution
Citizens United did not say there is a right to hide your contribution
Kennedy opinion protected people’s right to know
In Arizona every contribution over $50 must be disclosed
Except for the Dirty Money
Justice Scalia quote:
