(Act of 6 January 2000 on the Ombudsman for Children, Journal of Laws, Dz. U. No. 6, Item 69 as amended) as the legal basis of the Ombudsman’ s activity Powers the Ombudsman is vested with and most often exercised by the Team in individual cases: The possibility to inspect every case in situ, even without notice, Requiring, if needed, from public authorities, organisations or institutions to submit necessary explanations or information, as well as to provide access to files and documents. - requiring that proceedings be instituted in civil cases and entering into a proceeding being already in course with rights enjoyed by the prosecutor - entering into the already ongoing proceedings on juvenile cases with the rights enjoyed by the prosecutor. - requiring that preparatory proceedings be instituted by a competent prosecutor in cases of crime, - the possibility to address competent authorities, organisations or institutions to take measures aiming at protection of the child within the scope of responsibilities of those entities

Examples of individual cases pertaining to protecting children against violence, cruelty, exploitation, neglect and other ill-treatment Cases with opened proceedings: Criminal cases And court cases: Guardianship and custody (e.g.pertaining to issuing a decision on important affairs of the child, to limitation, suspension or deprivation of parental authority, establishing or dissolving a foster family, placement in institutional care), Divorce proceedings, Under the Act on upbringing in sobriety and counteracting alcoholism, Under the Act on counteracting alcoholism and drug addiction.

The number of individual cases in 2016 in connection with notification on the need to protect the child against violence, cruelty, exploitation, neglect or other ill-treatment In general, 4,972 cases reported in 2016 (in writing, by phone or personally)

Examples of interventions by the Ombudsman for Children in individual cases pertaining to protecting children against violence, cruelty, exploitation, neglect and other ill-treatment Requests for explanations: The Ombudsman requests explanations through the agency of the Team most often with respect to: The course of Police intervention The course of mandatory removal procedure Support provided under the Act on family violence prevention. Reasons for repeated hearings in criminal proceedings. Requesting measures to provide protection of the child, including instigating criminal proceedings The Ombudsman requests measures/ instigation of proceedings through the agency of the Team most often with respect to: representing the child correctly in criminal proceedings Resuming criminal proceedings Submitting comments and evaluations with respect to ongoing proceedings to units that supervise them
