UNC 0696: Addressing inequities between Capacity booking under the UNC and arrangements set out in relevant NExAs Purpose of Modification: To the extent to which a Consumer has entered into a bi-lateral Network Exit Agreement (NExA) with the relevant Transporter then any new or additional capacity charging should only apply from the relevant date set out in the NExA. Why change? In circumstances were separate (NExA) and UNC arrangements exist we have identified a conflict leading to a detrimental impact on Customers The NExA is between the Transporter & the Customer The UNC is between the Transporter & the Shipper The only party who is aware of the details of both the NExA and the UNC is the relevant Transporter If the NExA sets out a date from which Capacity can be off-taken and prohibits the customers taking capacity prior to this date we believe it is unreasonable to expect the Customer to pay for that Capacity prior to that date

Options Change the arrangements to align charges for capacity being off-taken under the UNC with the relevant date in the NExA

Solution It is proposed that any new or additional capacity requested under the UNC should only be chargeable from the date set out in the NExA. Business Rule 1 Any requests for new or additional capacity shall, were a relevant NEXA exists, only be chargeable from the relevant date set out in the NEXA. Business Rule 2 This change would be effective from [1st September 2018].

Recommended Steps The Proposer recommends that this modification should be: Not subject to self-governance because the change is material in relation to those customers it impacts Workgroup assessment to develop the modification for [3] months Preference would be for Distribution workstream to discuss
