Urgency Ordinance Amending Butte County Code Chapter 53

Recommended Motion Waive the reading of the ordinance; and adopt the Urgency Ordinance Amending Butte County Code Chapter 53 Articles I – Findings and Title, and Article IV – Emergency Interim Housing Inside the Camp Fire Area. (4/5 vote required); AND, Authorize Development Services and Public Health to refund fees related to Camp Fire Survivor’s permit fees paid to be refunded upon request.

Unincorporated Burn Area Parcels
Our Camp Fire Universe 6,759 total parcels in unincorporated burn area 2,116 vacant parcels 3,172 Parcels with qualifying structures w damage

Background FEMA, CalOES and Butte County have all been working in good faith to create MANY options for people to find temporary housing including: Outside the burn area, up to 2 RVs on a parcel that allows a residential unit on it (over 40,000 parcels eligible w property owner’s permission) Allow “dry camping” (up to 2 RVs) through July 29, 2019 Allow creation of Temp RV Parks on a variety of zones Allow dry camping on vacant parcels in the burn area Even, allowing camping on properties in the burn area with debris still present

Background Because the housing problem is so great, both the Town and the County agreed to allow people to live on their parcels with debris on them under certain conditions However, this specific matter was re-evaluated and determined that there are public health and safety risks AND there are issues with potential re-imbursement for the debris clean up costs (approx. $200 million in the unincorporated county)

Request Therefore, the County must amend Chapter 53, Articles I and IV removing language that allows survivors of the Camp Fire to reside on properties within the Camp Fire burn area with fire debris from a structure 120 square feet or larger prior to completion of debris removal.

Impact on Fire Survivors
This change does impact survivors living in a temporary dwelling on property with fire debris from a structure 120 square feet or larger: 26 Administrative Permits for temporary dwellings with power, water or septic connections Unknown number of survivors in RVs who are “dry camping” (not hooked up to utilities)

26 Administrative Permits for temporary dwellings with power, water or septic connections were issued Development Services Department will refund these permit fees with Board concurrence if requested by the property owner

This change only applies to temporary dwellings located on properties with debris This change does NOT impact the following properties inside the burn area: Unincorporated properties with houses that were not damaged by the fire may continue to be occupied Unincorporated properties that are vacant in burn area

Dry Camping is allowed until Monday, July 29, 2019, which is 180 days after the adoption of Chapter 53 on January 29, 2019 on properties that are: Inside the burn area on vacant parcels and with property owner’s permission Outside the burn area on all parcels that allow a residential use (not Industrial zone, commercial zones (except community commercial) with property owner’s permission
